RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
PROVIDING FOR THE PAYMENT OF FUNDS FOR ENVIRONMENTAL IMPACT
REPORTS INTO TRUST FUND, AND AUTHORIZING CITY MANAGER TO SIGN
CONTRACTS ON BEHALF OF THE CITY FOR ENVIRONMENTAL IMPACT REPORTS.
WHEREAS, it is necessary in conjunction with certain developments to have
environmental impact reports; and
WHEREAS, the City of San Rafael is charged with the duty of either obtaining
or providing said reports; and
WHEREAS, in certain instances the City does not have the capacity to prepare
said reports and said reports are prepared by independent contractors working
through the Planning Department; and
WHEREAS, the applicant pays to the City of San Rafael all funds necessary to
pay for said environmental impact reports and the signing of the contracts author-
izing the performance of the work is a routine matter, and the City acts only as
a conduit in relation to the funds for the payment of these environmental impact
reports.
NOW, THEREFORE, BE IT RESOLVED that there is already established by the City
of San Rafael a fund called the Trust and Agency Fund and all funds deposited with
the City for the payment of environmental impact reports shall be deposited in
said fund until such time as they shall be paid to the person or firm preparing
the environmental impact report pursuant to a contract entered into between the
City of San Rafael and said independent contractor.
BE IT FURTHER RESOLVED, that the City Manager of the City of San Rafael is
hereby authorized and empowered to sign any contract for the preparation and
supplying of environmental impact report to the City of San Rafael, in conjunction
with an application being processed by the Planning Department.
BE IT FURTHER RESOLVED, that the City Manager shall sign no contract with any
independent contractor to supply an environmental impact report unless and until
all funds, properly payable by the applicant, have been paid and deposited in the
Trust and Agency Fund.
I, MARION A. GRADY, City Clerk of the City of San Rafael, hereby certify that
the foregoing Resolution was duly and regularly introduced and adopted at a regular
meeting of the City Council of said City held on the 19th day of February, 1974,
by the following vote, to wit:
AYES: COUNCILMEN: Jensen, Miskimen, Mulryan, Nixon and Mayor Bettini.
NOES: COUNCILMEN: None.
ABSENT: COUNCILMEN: None.
