A RESOLUTION AUTHORIZING THE SIGNING
OF A LEASE OR AGREEMENT
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES as
follows;
The MAYOR and CITY CLERK are authorized to execute, on
behalf of the City of San Rafael a lease or agreement with
County -of Marin and City of San Rafael - Rond Sari ice Charge
Assessment Districts.
A copy of which is hereby attached and by this reference made a
part hereof.

hereby certify that the foregoing resolution was duly and regularly
introduced and adopted at a rega,Iar meeting of the

A G R E E M E N T
THIS AGREEMENT, made and entered into this r day

of ;�2 ,eC/fl,�� , 1974, by and between the COUNTY OF MARIN,

a political subdivision of the State of California, hereinafter
referred to as "County," and the CITY OF SAN RAFAEL, a municipal
corporation of the State of California, located within the County
of Marin, hereinafter referred to as "City";
W I T N E S S E T H:
WHEREAS, City has heretofore caused to be issued certain
special assessment bonds pursuant to the Improvement Act of 1911
and/or the Improvement Bond Act of 1915; and
WHEREAS, County has acted by and through its Tax Collector -
Treasurer, as fiscal agent for City, in connection with bonds issued
pursuant to said Acts, under the terms of an Agreement between City
and County dated June, 1966; and
WHEREAS, County has now determined that the cost of servicing
bonds must be increased over the amount set forth in said prior
contract;
NOW, THEREFORE, IT IS AGREED AS FOLLOWS:
1. County shall act as City's fiscal agent in connection
with special assessment bonds heretofore issued and hereafter to be
issued by City pursuant to the Improvement Act of 1911 or the
Improvement Bond Act of 1915. County shall perform any and all
duties required to be performed and/or authorized to be taken in
connection with bonds issued pursuant to said Acts.
2. City shall pay County the sum of $40.00 for each bond
serviced by County in the Bahia de Rafael Industrial Park Assessment

District, City of San Rafael, Marin County, California, confirmed
on the 5th day of February, 1973. For all bonds issued subsequent
to those issued for Bahia de Rafael Industrial Park Assessment
District, which the County shall collect on behalf of the City,
the following charges shall be in full force and effect:
(a) $40.00 for each bond serviced by County issued
pursuant to the Improvement Bond Act of 1915, and
(b) $50.00 for each bond serviced by County issued
pursuant to the Improvement Act of 1911.
3. Subject to City passing a resolution requesting the
services described above and County passing a resolution consent-
ing to providing such services, this Agreement will be applicable
to special assessment bonds issued by City pursuant to said Acts
commencing with Bahia de Rafael Industrial Park Assessment District
and thereafter.
4. For all bonds issued prior to those provided in the
Bahia de Rafael Industrial Park Assessment District, the Agreement
between City and County dated June, 1966 shall remain in full force
and effect.
5. If requested by County, City shall appoint the Tax
Collector -Treasurer of the County of Marin to the position of
Deputy Treasurer of the City of San Rafael, and in connection
therewith, City will provide, without cost to County, any additional
surety bonds which may be required of said Tax Collector -Treasurer
because of this Agreement.
IN WITNESS WHEREOF, the parties hereto have authorized
their duly authorized representatives to execute the within
