HomeMy WebLinkAboutCC Resolution 4694RESOLUTION NO. 4694 RESOLUTION OF THE CITY OF SAN RAFAEL REQUESTING THE BOARD OF SUPERVISORS OF MARIN COUNTY TO PROVIDE FOR THE CONSOLIDATION OF A SPECIAL MUNICIPAL ELECTION WITH THE STATE OF CALIFORNIA DIRECT PRIMARY ELECTION TO BE HELD ON JUNE 4, 1974. WHEREAS, the City Council of the City of San Rafael on March 4, 1974 adopted Resolution No. 4683 calling a special municipal election to be held in the City of San Rafael on Tuesday, June 4, 1974, at which election will be submitted to the qualified electors of the City the following measures, to wit: MEASURE ( ): $3,500 MAXIMUM FOR THE PURCHASE Shall Section 3.1 of Article OF SUPPLIES, MATERIALS, MACHINERY XIII of the Charter of the City OR EQUIPMENT NOT LET BY BID) of San Rafael be amended to pro- vide that the City of San Rafael shall have the power to award contracts without going to bid for the purchase of supplies, materials, machinery and equipment amounting to $3,500 or less. The text of said amendment is set forth in Sec- tion A of Resolution No. 4675 passed by the City Council of the City of San Rafael on Tuesday, February 19, 1974, and is now on file in the office of the City Clerk. MEASURE ( ): GENERAL MUNICIPAL ELECTION TO BE Shall Section 1 of Article IV of HELD ON TUESDAY AFTER THE FIRST the Charter of the City of San MONDAY IN MARCH) Rafael be amended to provide that the general municipal election held on each odd numbered year shall be on the Tuesday after the first Monday in March rather than on the third Tuesday in April. The text of said amendment is set forth in Section B of Resolution No. 4675 passed by the City Council of the City of San Rafael on Tuesday, February 19, 1974, and is now on file in the office of the City Clerk. MEASURE ( ): CITY ATTORNEY TO BE APPOINTIVE Shall the Charter of the City of RATHER THAN ELECTIVE) San Rafael be amended effective at midnight the day prior to the next general municipal election in 1975, so as to make the office of city attorney appointive rather than elective. The -text of said amend- ment is set forth in Section C of Resolution No. 4675 passed by the City Council of the City of San Rafael on Tuesday, February 19, 1974, and is now on file in the office of the City Clerk. AND WHEREAS, a State of California Direct Primary Election will be held on Tuesday, June 4, 1974 and it is the desire of the City Council that said special municipal election be consolidated with said Direct Primary Election; NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Rafael, as follows: Section 1. The Board of Supervisors of Marin County is hereby requested to order the consolidation of said special municipal election with said Direct Primary Election to be held on Tuesday, June 4, 1974 insofar as the City is concerned, and to further provide that within the territory affected by said order of consolidation, to with the City, the election precincts, polling ORICilmu I places and voting booths shall in every case be the same and there shall be only one set of election officers in each of said precincts, and to further provide that said measures hereinabove set forth shall be set forth in the form of ballot to be used at said election insofar as the same is held within the City. The Board of Supervisors of Marin County is further requested to order the County Clerk of such County (i) to set forth on all sample ballots relating to said consolidated elections, to be mailed to the qualified electors of the City, said measure herein- above set forth, and to mail with said sample ballots to said electors printed copies of arguments (if any) for and against said measures, and (ii) to provide absent voter ballots for said Direct Primary Election and said special municipal election consolidated therewith for use by qualified electors of the City who are entitled thereto, in the manner provided by law. Section 2. The Board of Supervisors of Marin County is hereby further authorized to canvass, or cause to be canvassed, as provided by law, the returns of said special municipal election with respect to the votes cast on said measure and to certify such canvass of the votes cast for and against said measure to this Council. Section 3. The City Clerk is hereby authorized and directed to certify to the due adoption of this resolution and to transmit a copy hereof so certified to the Board of Supervisors of the County and to file a copy hereof so certified with the County Clerk of the County.
