HomeMy WebLinkAboutOrdinance 832 (Requirements by Slope)ORDINANCE NO. eQ .�,7 2 __ AN ORDINANCE AMENDING TITLE 15 OF THE SAN RAFAEL MUNICIPAL CODE BY AMENDING SECTION 15.32.010, RELATING TO SIZE AND SHAPE OF LOTS, AND BY THE ADDITION OF CHAPTER 15.34,REGARDING REQUIREMENTS BY SLOPE. THE COUNCIL OF THE CITY OF SAN RAFAEL DO ORDAIN AS FOLLOWS: SECTION 1: Section 15.32.010 of the San Rafael Municipal Code is hereby amended to read as follows: 15.32.010 Size and shape. The size and shape of lots shall conform to the Zoning regulations effective in the area of the proposed subdivision and shall be related to:the accessibility to a public street; the character of the neighborhood; the improvement status of abutting streetsi grading plans for the subdivision; and the natural topography of the property as outlined in Chapter 15.34, Requirements by Slope, of this Title. Lots shall be not less than fifty (50) feet in width, nor less than five thousand (5,000) square feet in area, nor less than eighty (80) feet in depth, provided that for corner lots the width shall be not less than sixty (60) feet. The Planning Commission may recommend the granting of exceptions to this provision where lots are to be used for commercial or industrial purposes, where there are unusual topographic conditions, curved or cul-de-sac streets exist, where a Planned Community or a Planned Unit Development has been approved, or where other special conditions warrant exceptions in the lot area, lot depth, and lot width requirements. SECTION 2: Title Fifteen, the Subdivision Ordinance of the City of San Rafael, is hereby amended by adding Chapter 15.34, Requirements by Slope, which is to read as follows: CHAPTER 15.34 REQUIREMENTS BY SLOPE Sections: 15.34.010 Objectives 15.34.020 Subdivisions on standard city streets 15.34.030 Subdivisions on substandard city streets 15.34.010 Objectives. One of the objectives of the San Rafael General Plan is to preserve the natural beauty of the surrounding hillsides while allowing reasonable use of these areas for development purposes. The "Requirements by Slope" are intended to implement this objective by requiring that the lots in hillside subdivisions be realistically related to the natural topography of the land so as to limit grading; retain much of the natural terrain; and, in the case of existing substandard streets, provide for additional on site parking. 15.34.020 Subdivisions on standard city streets. Where daylighted cuts or fills are proposed, the percent of slope shall be measured on the ground conditions after the daylight grading is accomplished. (c) Where a reasonable and realistic access to an adequate building site can be demonstrated, a lot with lesser width and area than required by the percent of slope may be allowed. 15.34.030 Subdivisions on substandard city streets. In the subdivision of lots on existing substandard city streets the following regul6tions shall apply: (a) Each lot created shall have a driveway, the grade of which shall not exceed 18%, with adequate provision for ingress and egress. Said driveway shall relate to and terminate at a parking area sufficient to accomodate no less than four (4) automobiles. Said parking area shall be located behind the required front setback line. -2- (b) Frontage and area of each lot created shall, in addition to the conditions outlined in (a) above, conform to the minimum Zoning requirements of the district in which the subdivision is located. SECTION 3: This Ordinance shall be published once in full before its final passage in the Independent Journal, a daily newspaper of general circulation, printed, published and circulated in the City of San Rafael, and shall be in full force and effect thirty (30) days after its final passage. gad /Y eewl� C.
