Leoncini, Agency Secretary RE: FILLING OF REDEVELOPMENT CITIZENS ADVISORY COMMITTEE VACANCY - File R-140 IV -B Mayor Boro announced that at a Special Meeting held earlier this evening, the Agency appointed Andrea LeCoq to the Redevelopment Citizens Advisory Committee. Settlement, APN: 013-052-03; Robello Settlement, APN: 013-031-25; Nichelini Settlement, APN: 013-031-24. RESOLUTION NO. 96-30 - RESOLUTION ACCEPTING GRANT OF EASEMENT FOR A FENCELINE EASEMENT ON LANDS OF ISI/PEDROLI SETTLEMENT, APN: 013-052-04. RESOLUTION NO. 96-31 - RESOLUTION ACCEPTING GRANT OF EASEMENT FOR A FENCELINE EASEMENT ON LANDS OF JACKSON SETTLEMENT, APN: 013-094-14. Member Cohen moved and Member Phillips seconded, to adopt the Resolution approving the property purchase agreement on lands of Shirley Settlement, APN: 013-081-34. RESOLUTION NO. 96-35 - RESOLUTION APPROVING PROPERTY PURCHASE AGREEMENT ON LANDS OF SHIRLEY SETTLEMENT, APN: 013-081-34. AYES MEMBERS: Cohen, Heller, Phillips & Chairman Boro NOES: MEMBERS: None ABSENT: MEMBERS: None DISQUALIFIED: MEMBERS: Zappetini (due to conflict of interest) Member Zappetini stated he was abstaining from items 4, 5 and 6, due to conflict of interest, and left the Council Chamber. Acting Executive Director Ours explained items 4, 5, and 6 are the first step in the process necessary to acquire the properties necessary for easements on the Andersen Drive project. He reported the owners of these properties have not responded positively to negotiations; therefore, the Agency must file the necessary petitions with the court, taking the first step toward condemning these properties. ANDERSEN DRIVE EXTENSION - RESOLUTION FINDING THAT THE PUBLIC NECESSITY REQUIRES THE ACQUISITION OF A FENCELINE EASEMENT ON LANDS OF BARTHOLOW TRUST, APN: 013-072-21 (PW) - File R-359 x R-246 Member Cohen asked if the Agency was required to give the property owner the opportunity to appear before the Agency and be heard? Chairman Boro and Acting Executive Director Ours reported the property owners had been notified, and Chairman Boro asked if there was anyone wishing to speak on this item. There was no public comment. Member Phillips moved and Member Heller seconded, to adopt the Resolution finding that the Public Necessity requires the acquisition of a fenceline easement on certain real property owned by Bartholow Trust. RESOLUTION NO. 96-36 - RESOLUTION FINDING THAT THE PUBLIC NECESSITY REQUIRES THE ACQUISITION OF A FENCELINE EASEMENT ON CERTAIN REAL PROPERTY OWNED BY BARTHOLOW TRUST FOR ANDERSEN DRIVE EXTENSION PROJECT, APN: 013-072-21. AYES: MEMBERS: Cohen, Heller, Phillips & Chairman Boro NOES: MEMBERS: None ABSENT: MEMBERS: Zappetini DISQUALIFIED: MEMBERS: Zappetini (due to conflict of interest) 5. RESOLUTION NO. 96-37 - RESOLUTION FINDING THAT THE PUBLIC NECESSITY REQUIRES THE ACQUISITION OF A FENCELINE EASEMENT ON CERTAIN REAL PROPERTY OWNED BY KENTON T. DEVRIES, DONALD DEVRIES, RICHARD DEVRIES, AND NANCY FREGOSO FOR THE ANDERSEN DRIVE EXTENSION PROJECT, APN: 013-052-05. AYES: MEMBERS: Cohen, Heller, Phillips & Chairman Boro NOES: MEMBERS: None ABSENT: MEMBERS: Zappetini DISQUALIFIED: MEMBERS: Zappetini (due to conflict of interest) 6. RESOLUTION NO. 96-38 - RESOLUTION FINDING THAT THE PUBLIC NECESSITY REQUIRES THE ACQUISITION OF AN EASEMENT FOR ROADWAY AND LANDSCAPING PURPOSES ON CERTAIN REAL PROPERTY OWNED BY PACIFIC GAS &ELECTRIC COMPANY FOR THE ANDERSEN DRIVE EXTENSION PROJECT, APN: 013-012-12. AYES: MEMBERS: Cohen, Heller, Phillips & Chairman Boro NOES: MEMBERS: None ABSENT: MEMBERS: Zappetini DISQUALIFIED: MEMBERS: Zappetini (due to conflict of interest) 7.
