Consideration of an Ordinance Adopted as an Urgency Measure Terminating a Temporary Moratorium on the Establishment and Operation of New Massage Establishments within the City of San Rafael (CD) — File 9-10-3 Urgency Ordinance Terminating Massage Moratorium Raffi Boloyan, Planning Manager, presented the staff report Councilmember McCullough / Raffi Boloyan Councilmember McCullough / Raffi Boloyan Councilmember Colin / Raffi Boloyan Councilmember Colin Mayor Phillips / Raffi Boloyan Mayor Phillips / Raffi Boloyan Mayor Phillips Mayor Phillips / Raffi Boloyan Mayor Phillips / Raffi Boloyan Mayor Phillips / Raffi Boloyan Mayor Phillips declared the public hearing opened Rhonda Kutter, Massage Ordinance Advisory Committee Chair D Mayor Phillips / Rhonda Kutter Stacey DeGooyer Tony Siacotos, Government Relations Chair of the American Massage Therapy Association Carol Thompson, Downtown Business Improvement District Director Fritzi Schnell Jonathan Frieman There being no further comment from the audience, Mayor Phillips closed the public hearing Councilmember McCullough The title of the ordinance was read: ORDINANCE NO. 1935 - AN ORDINANCE OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ADOPTED AS AN URGENCY MEASURE TERMINATING A TEMPORARY MORATORIUM ON THE ESTABLISHMENT AND OPERATION OF NEW MASSAGE ESTABLISHMENTS WITHIN THE CITY OF SAN RAFAEL Councilmember McCullough moved and Councilmember Colin seconded to approve adoption of Ordinance No. 1935; however, City staff to remain open to tools explored and analyzed, and at this time rejected as not necessary, or not necessarily effective, given the alternatives available. City Manager's Report: • City Manager Jim Schutz stated that this week is California's fourth annual electric vehicle week and announced a downtown event on Friday, October 9, 2015 from 12-7pm to test drive electric vehicles. The event will coincide with the Art Walk as well as the San Rafael and Mill Valley Film Festival. He introduced Dean Allison, new Public Works Director. COUNCILMEMBER REPORTS / REQUESTS FOR FUTURE AGENDA ITEMS: (including AB 1234 Reports on Meetings and Conferences Attended at City Expense) 7. Councilmember Reports: • Councilmember Bushey reported on a recent ABAG meeting 5 • Mayor Phillips • Mayor Phillips reported that he attended the Presentation of the Beacon Award in San Jose with Cristine Alilovich, Assistant City Manager, last week. o He watched a Marin Clean Energy workshop • Councilmember McCullough reported that he attended the Marin Clean Energy board retreat and follow-up subcommittee meeting last week where the future governance of Marin Clean Energy was discussed.
