SUBJECT: Recommendation to Call for Applications to Fill a Vacancy on the City Council
RECOMMENDATION: Approve staff recommendation to call for applications.
DISCUSSION: City Councilmember Marc Levine will be sworn as a new State Assemblyman on December
3rd, however, his election has not yet been certified (at the time of the writing of this report) because the
Sonoma County Registrar's office is continuing to count absentee and provisional ballots. Pursuant to state
law, Councilmember Levine will forfeit his seat on the San Rafael City Council upon his election to the State
office. His resignation letter to the City has been submitted.
This resignation will create a vacancy on the Council. Article VI, Section 6 of the Charter of the City of San
Rafael states that if the City Council fails for a period of sixty days to fill a vacancy it shall immediately call for
an election to do so. If the Council elects to make an appointment, the appointment term would be for the
remainder of the unexpired term, or until December 2013.
Staff recommends that the City Council call for applications, but not commence with interviews until the
certification of the election confirming Mr. Levine's election to State office. Further, the following schedule is
recommended:
• Dec 4th. Call for applications.
• Dec. 17th. 5 p.m. deadline for receipt of applications.
• Date tbd, prior to Jan. 7, 2011 City Council to set a Special City Council meeting to interview finalists
• January 7, 2013. First meeting of the newly appointed Councilmember.
Any applicant must be a registered voter of the City of San Rafael. It is expected that the newly appointed
Councilmember will attend the League of California Cities conference January 16-18"' conducted specifically
for new Councilmembers,

I will be sworn in as a new State Assemblymember on December 3rd, however, my
election has not yet been certified because the Sonoma County Registrar's office is
continuing to count absentee ballots. Pursuant to state law, I will forfeit my seat on the
San Rafael City Council upon my election to the Assembly. I intend to resign as a San
Rafael City Councilmember immediately upon the certification of my election to the
State Assembly. However, out of respect to both offices, I will delay my official
resignation from the City until the State election is certified. Further, I will not attend any
further San Rafael City Council meetings as a member of the Council (my last official
meeting was November 19th), and the Council may take action as it deems appropriate
to address the soon -to -be -empty Council seat.
It's been an honor and a privilege to serve on the city council. I look forward to working
directly with you well into the future to be sure our local interests are served by the State
Legislature.
