HomeMy WebLinkAboutCC Resolution 13906 (Hazardous Materials Spills Management JPA)RESOLUTION NO. 13906 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE CITY MANAGER TO EXTEND FOR ONE YEAR THE CITY OF SAN RAFAEL'S PARTICIPATION IN THE 2005 JOINT POWERS AGREEMENT FOR HAZARDOUS MATERIALS SPILLS MANAGEMENT. WHEREAS, the most recent Joint Powers Agreement for Hazardous Materials Spills Management was finalized in June 2005 and will reach the end of its ten (10) year term on June 30, 2015, and; WHEREAS, participation in this agreement prepares the San Rafael Fire Department for multi - agency and multi jurisdictional responses to hazardous materials emergencies and encourages compliance with California Emergency Services Act (ESA) for multi jurisdictional Hazardous Materials Responses, and; WHEREAS, the City of San Rafael desires to extend the City's participation in the Joint Powers Agreement for Hazardous Materials Spills Management to allow the parties to the Agreement sufficient time to review the Agreement and make necessary changes for a new long-term agreement NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby authorize the City Manager to extend for one year the City of San Rafael's participation in the 2005 Joint Powers Agreement for Hazardous Materials Spills Management, by executing the letter agreement issued by the Marin County Fire Chiefs Association, dated March 23, 2015, attached hereto as Exhibit A. BEIRNE, City Clerk CO Marin County Fire Chiefs Association �F0 City of San Rafael 1400 Fifth Ave. Room 203 PO Box 151560 San Rafael, CA 94915 March 23, 2015 Re: Extension of Joint Powers Agreement for Hazardous Materials Spills Management Dear Nancy Mackie, As you know, the above referenced Agreement expires on June 30, 2015. 1 am in the process of reviewing the Agreement and will be contacting all of the agencies during the next 6-9 months to make any necessary improvements. In the interim, we would like to extend the terms of the Agreement for one more year so that the expiration date would be June 30, 2016. Accordingly, it is hereby requested that you gain approval from your agency for the Agreement's extension for one additional year. County Counsel has indicated that this letter can serve as the extension of the Agreement so long as each Agency signs the letter (below) to be bound by the original Agreement. I have attached the original Agreement for your review. Please contact me if you have any questions regarding this matter. Very truly yours, Jason Weber, Marin County Fire Chiefs Association By signing this letter, The City of San Rafael agrees to the extension of all of the terms of the 'Joint Powers Agreement for Hazardous Materials Spills Management' that was signed by the parties in 2005, excepting Section 3, which is hereby modified to have a termination date of June 30, 2016.
