RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AUTHORIZING THE CITY MANAGER TO EXECUTE AN AGREEMENT FOR
PROFESSIONAL PLANNING SERVICES WITH AMY SKEWES-COX FOR
ENVIRONMENTAL SERVICES RELATED TO THE PROCESSING OF THE EDEN
HOUSING/WHISTLESTOP DEVELOPMENT PROJECT PLANNING APPLICATIONS
(Terms of Agreement: Agreement term from September 2015 through January 2017, with a budget amount not to
exceed $12.217.00 for Phase I work and estimated budget of $220,000.00 for Phase II work; plus a 25%
administrative surcharge fee. All costs to be reimbursed to the City through cost recovery from the project
applicants.)
WHEREAS, the City of San Rafael has determined that professional services are needed
to assist the Community Development Department in the conduct of environmental review for
the Eden Housing/Whistlestop Development Project proposed at 930 Tamalpais Avenue; and
WHEREAS, Amy Skewes-Cox, AICP has been selected to provide environmental
consulting services which have been identified as necessary for processing of the Eden
Housing/Whistlestop development project; and
WHEREAS, on August 17, 2015, Amy Skewes-Cox submitted a "Proposal for Services"
dated August, 2015 containing a scope of work, budget and term for providing the environmental
services identified in a Request for Proposal that was prepared for the project, which identified
two phases of work anticipated as required for the project, with a proposed budget cap of
$12,217.00 for the proposed Phase I work and an estimate of $220,000 for the anticipated Phase
II work, plus 25% City administrative surcharge fee, and with a contract term for all phases
extending through January 2017; and
WHEREAS, City staff has presented to the City Council a form of Agreement for
Professional Planning Services, attached hereto as Attachment 1 and incorporated herein by
reference, which attaches and approves the "Proposal for Services" dated August, 2015, and
authorizes the Phase I work for a not -to -exceed amount of $12,217.00; and
WHEREAS, the form of Agreement attached as Attachment 1 further provides that Amy
Skewes-Cox shall submit a final scope of work, budget and term for Phase II work, following
completion of the work approved for Phase I, for review and approval by the CITY MANAGER;
that work on Phase II is not guaranteed by the Agreement, but that upon the acceptance of a final
Phase II scope, budget and term, the CITY MANAGER is authorized, without further City Council
authorization, to review and approve a Professional Services Agreement amendment to complete
Phase II work on a time and materials basis with a not to exceed amount of $275,000.00.
NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael
does hereby authorize the City Manager to execute, on behalf of the City of San Rafael, the
Agreement for Professional Planning Services with Amy Skewes-Cox, in the form attached as
"Attachment 1", which includes as Exhibit A thereto the "Proposal for Services" dated August,
2015 submitted by Amy Skewes-Cox.
I, ESTHER C. BIERNE, Clerk of the City of San Rafael, hereby certify that the foregoing
Resolution was duly and regularly introduced and adopted at a regular meeting of the City
Council of said City held on Tuesday, the 8`h day of September, 2015 by the following vote, to
wit:
