HomeMy WebLinkAboutCC Resolution 13289 (Regulatory Fees)RESOLUTION NO. 13289 RESOLUTION APPROVING AMENDED CONDITIONALLY EXEMPT SMALL QUANTITY GENERATOR REGULATORY FEES. WHEREAS, the City Council of the City of San Rafael on May 20, 1996 adopted Ordinance No. 1696 amending the San Rafael Municipal Code (SRMC), to add Chapter 9.23, Regulatory Fees for Conditionally Exempt Small Quantity Generator Waste Activities; and WHEREAS, the purpose and intent of the Small Quantity Generator Regulatory Fees is to ensure, in part, the future health, safety, and general welfare of the City's citizens by establishing a funding source to pay for the operating expenses of the City's conditionally exempt small quantity generator waste collection facility for receipt and disposition of so-called small quantity generator waste generated and brought to the facility by commercial sources; and WHEREAS, SRMC Section 9.23.030 authorizes the City Council of the City of San Rafael to periodically set by Resolution the rates for the Conditionally Exempt Small Quantity Generator Regulatory Fees, which will be paid by every person, corporation or other entity which generates and brings conditionally exempt small quantity generator waste to the City's collection facility, in accordance with the approved budget for operating expenses for the City conditionally exempt small quantity generator collection program; and WHEREAS, the City Council of the City of San Rafael on this date held a public hearing to review and receive public comment on the proposed Conditionally Exempt Small Quantity Generator Fees; and WHEREAS, the City Council at the public hearing reviewed the staff report prepared by the Fire Department containing the proposed Conditionally Exempt Small Quantity Generator Fees; and WHEREAS, the City Council finds that the health, safety and general welfare of the City's citizens require the funding of the conditionally exempt small quantity generator collection program. NOW THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael rescinds Resolution No. 9730, and approves the proposed rates for the Conditionally Exempt Small Quantity Generator Fees, as set forth in Exhibit "A" hereto, to remain in effect hereafter until amended. suspended, or rescinded by Resolution of the City Council. BE IT FURTHER RESOLVED that the City Council of the City of San Rafael finds that the actions taken by the Resolution are not subject to the California Environmental Quality Act (CEQA), pursuant to Article 5. Section 15061(b) (3 )) of the CEQA Guidelines because there is no possibility that they will have a significant effect on the environment as provided by CEQA. The City Clerk is hereby directed to file the necessary Notice of Exemption as provided under CEQA. I, ESTHER C. CITY OF SAN RAFAEL NOTICE OF PUBLIC HEARING BEFORE THE SAN RAFAEL CITY COUNCIL PROPOSED AMENDMENTS TO THE CONDITIONALLY EXEMPT SMALL QUANTITY GENERATOR REGULATORY FEE RESOLUTION. DATE/TIME: Tuesday, January 17, 2012, at 8:00 p.m. LOCATION: City Council Chambers, City Hall, 1400 Fifth Avenue, San Rafael, CA PURPOSE: To receive public comments and to consider adoption of amendments to the Conditionally Exempt Small Quantity Generator (CESQG) Regulatory Fee Resolution. The CESQG Regulator Fee Resolution has not been modified since adoption on October 21, 1996. As specified in the original Resolution, the San Rafael Municipal Code (SRMC) Section 9.23.030 authorizes the City Council to periodically set the CESQG rates by Resolution. Staff has updated the fee table and added a $25 processing fee to keep pace with other Bay Area waste collection facilities while keeping the fees affordable. Compared to the current Resolution, 28% of the fee items on the amended Resolution increased, 25% of the fee items decreased, 36% stayed the same, and 11 % are new fee items. The amended Resolution eliminates the 10% administration and facility closure fee.
