HomeMy WebLinkAboutCC Resolution 13363 (Animal Contral Master Fee Schedule)RESOLUTION NO. 13363 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AMENDING THE MASTER FEE SCHEDULE FOR ANIMAL CONTROL SERVICES FEES WHEREAS, the City Council on August 1, 2011 adopted Resolution No. 13218, establishing the Master Fee Schedule for the City of San Rafael, including a schedule of fees for Animal Control Services as set forth in Exhibit "J" which continued the level of fees for Animal Control Services previously set in 2010 by Resolution No. 12918 ; and, WHEREAS, the Joint Powers Agreement, dated May 22, 1979, between the County of Marin, the City of San Rafael, and other cities in the County, provides for the provision of Animal Control Services by the County of Marin through its contract with the Marin Humane Society, and requires that the City of San Rafael maintain its Animal Control Services fees in conformity with the fees established by the County of Marin; and WHEREAS, the County of Marin Board of Supervisors on May 22, 2012, after a duly noticed public hearing, adopted an ordinance authorizing revised Animal Control Services fees, subject to all the parties to the Animal Control Services Joint Powers Agreement approving such revised fees; and WHEREAS, the County of Marin Office of the Administrator in its staff report supporting the Board of Supervisors' adoption of an ordinance stated that the increased animal control services fees would not exceed the cost of providing the services associated with those fees; and WHEREAS, the City Clerk pursuant to Government Code Sections 66018 and 6062a has published notices of a public hearing concerning the City's proposed amendment of Master Fee Schedule by adoption of a Resolution revising Schedule "J" of the Master Fee Schedule concerning Animal Control Services fees. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Rafael hereby amends the existing Master Fee Schedule, Resolution No. 12918, by deleting Exhibit "J" now contained therein, and substituting the revised Exhibit "J" as shown on the Attachment hereto, establishing new Animal Control Services fees consistent with the Marin County Ordinance, dated May 22, 2012, effective upon the date that the Marin County Board of Supervisors adopts a Resolution memorializing approval by all the members of the Animal Control Services Joint Powers Agreement of the Animal Control Service fees authorized by the Marin County Ordinance, dated May 22, 2012. 1, Esther C. In April of 2012, staff conducted a survey of neighboring jurisdictions such as San Mateo, San Francisco, Contra Costa, and Berkeley, and determined that increases to Marin's fee schedule are both appropriate and consistent with these other jurisdictions. Additionally, the Marin Humane Society has confirmed that the proposed fee increases do not exceed the cost of providing the associated services. Finally, City/Town Managers were presented with the revised fees during a regularly scheduled meeting on April 24, 2012 and are in agreement with the proposed changes. The last Animal Control fee increase was in 2009. FISCAL IMPACT: Anticipated annual revenue increase is estimated to be $29,000 for the County and $71,000 for Marin cities/towns. ORDINANCE OF THE MARIN COUNTY BOARD OF SUPERVISORS ESTABLISHING INCREASED IN FEES COLLECTED FOR ANIMAL CONTROL SERVICES CODIFIED IN CHAPTER 8.04 OF TITLE 8 OF THE MARIN COUNTY CODE THE BOARD OF SUPERVISORS OF THE COUNTY OF MARIN HEREBY ORDAINS AS FOLLOWS: SECTION 1. SECTION II. This ordinace shall be liberally construed to achieve its purposes and preserve its validity. If any section, subsection, sentence, clause or phrase of this ordinance is for any reason held to be unconstitutional or invalid, such decision shall not affect the validity of the remaining portion of this ordinance. The Board of Supervisors hereby declares that it would have passed this ordinance and every section, subsection, sentence, clause or phrase thereof, 3 irrespective of the fact that any one or more sections, subsections, sentences, clauses or phrases be declared unconstitutional or invalid. SECTION Ill. Effective Date. This ordinance shall be and is hereby declared to be in full force and effect as of thirty (30) days from and after the date of its passage and shall be published once before the expiration of fifteen (15) days after its passage, with the names of the supervisors voting for and against the same in the MARIN INDEPENDENT JOURNAL, a newspaper of general circulation published in the County of Marin.
