HomeMy WebLinkAboutCC Resolution 13139 (Target)RESOLUTION NO. 13139 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL ACCEPTING COMMUNITY IMPACT REPORT ON PROPOSED 137,511 -SQUARE -FOOT TARGET STORE PROJECT ON LOT 6 AT THE SHORELINE CENTER, 125 SHORELINE PARKWAY (APN 009-320-45) GPA07-004, ZC07-002, UP07-018, ED07-038, S10-002 The City Council of the City of San Rafael finds and determines that: WHEREAS, on May 11, 2007, planning permit applications were filed with the City of San Rafael, Planning Division proposing development of an approximately 137,000+ -square -foot Target retail store at the San Rafael Shoreline Center. The initial project proposed development on an 19.42 - acre site located at 125 Shoreline Parkway; and WHEREAS, on October 19, 2009, the San Rafael City Council held a duly -noticed public hearing on the FEIR, accepting all oral and written public testimony and the written report of the Community Development Department staff. Following closure of the public hearing and deliberation, the City Council, on a 5-0 vote, adopted Resolution No. 12858 certifying the Target Store FEIR. The FEIR includes, among others, an assessment of potential urban decay resulting from the project, finding that this potential impact would be less -than -significant. The FEIR certification was based on and supported by findings, which are incorporated herein by reference; and WHEREAS, on December 6, 2010, the City Council held a duly noticed public hearing on the proposed planning applications, and an Addendum to the certified FEIR prepared for the Target Store project. The City Council accepted all public testimony and the written report of the Department of Community Development. Following closure of the public hearing, the City Council voted to continue the matter to December 20, 2010 in order for staff and Target representatives to respond to questions; and WHEREAS, on December 20, 2010, the City Council reviewed and considered responses to public testimony/comments, including, among others, comments and questions concerning the potential social and economic impacts of the proposed Target Store on the greater San Rafael area. Following closure of the public hearing, the City Council voted to continue the matter to a date uncertain in order for staff to prepare a Community Impact Report for the project; and WHEREAS, the concerns raised by the public about social and economic impacts are not physical, environmental impacts required to be analyzed as part of the environmental review process required under the California Environmental Quality Act (CEQA). However, as the social and economic impacts do impact the City's analysis of the potential benefits of the project to the community, it was determined that a Community Impact Report be prepared in order to assist in making findings of overriding consideration required under CEQA in order to consider approval of the project; and WHEREAS, on January 3, 2011, the City Council approved Resolution No. 13090, authorizing the Interim City Manager to execute an agreement for professional services with AECOM Technical Services, Inc. ("AECOM") for the preparation of a Community Impact Study for the proposed Target Store at Shoreline Center. At this meeting, the City Council heard public comments on the proposed scope of work and recommended the following additions to the Community Impact Report: the addition of two case studies for a total of six case studies including the Novato and Napa Target stores and additional information on estimated taxable versus non taxable sales at the proposed San Rafael Target store. The City Council also authorized the Economic Development Director to include additions to the Scope of Work that were contained in written requests submitted by January 17, 2011, as long as the additions did not increase the Community Impact Report cost in excess of $100,000; and 1-1 WHEREAS, Resolution No. 13090, authorized the Interim City Manager to modify the scope of work for the Community Impact Report as appropriate to include changes or additions as were directed by the City Council at the meeting of January 3, 2011, provided that the total compensation to AECOM for the Community Impact Report did not exceed $100,000; and WHEREAS, the staff report for recommending approval of Resolution 13090, included the components to be included in the Community Impact Report. These components were retail market analysis, economic impact analysis, fiscal impact analysis and case studies assessing the economic impact of the addition of a Target store in four cities; and WHEREAS, following the January 3, 2011 City Council hearing, the Economic Development Director received three written requests for additions to the scope of work and provided a written response to the individuals on January 28, 2011. The Economic Development staff provided a written clarification to the scope of work to AECOM on February 11, 2011; and WHEREAS, on April 4, 2011, the San Rafael Community Impact Study of a Proposed Target Retail Store (Community Impact Report), prepared by AECOM was published; and WHEREAS, on April 18, 2011, the City Council held a public hearing accepting and considering comments on the Community Impact Report. Following closure of the public hearing, AECOM representatives and City staff responded to comments. NOW, THEREFORE, BE IT RESOLVED that the City Council hereby accepts the San Rafael Community Impact Study of a Proposed Target Retail Store (Community Impact Report), prepared by AECOM, dated March 31, 2011.
