HomeMy WebLinkAboutCC Resolution 12948 (Transportation Commission Grant)RESOLUTION NO. 12948 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE CITY MANAGER TO EXECUTE A FUNDING AGREEMENT TO ACCEPT AND EXPEND A GRANT IN THE AMOUNT OF $528,000 FROM THE METROPOLITAN TRANSPORTATION COMMISSION FOR STATION AREA PLANS FOR THE DOWNTOWN SAN RAFAEL AND THE CIVIC CENTER RAIL STATIONS (P09-005) WHEREAS, the Metropolitan Transportation Commission provides grants for city - sponsored planning efforts to match future transit extensions in the Bay Area with supportive local land use plans and policies that promote high levels of transit ridership and enable more walking and biking for healthier communities, reduce dependence on single -occupant vehicle trips and reduce traffic congestion and improve air quality; and WHEREAS, the City of San Rafael applied for and has been awarded a grant in the amount of $528,000 from the Metropolitan Transportation Commission to fund Station Area Plans for the future Downtown San Rafael and Civic Center stations; and WHEREAS, this project includes $132,000 in matching funds, with $9,000 from the City of San Rafael from Energy and Environmental Block Grant funds, $5,000 in Redevelopment Agency funds, and $118,000 from partner agencies in the planning projects. NOW, THEREFORE, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL DOES HEREBY RESOLVE as follows: The City Manager is authorized to execute, on behalf of the City of San Rafael, an agreement to accept and expend a grant in the amount of $528,000 from the Metropolitan Transportation Commission for Station Area Plans for the Downtown San Rafael and the Civic Center Rail Stations, as shown in Exhibit 1, SMART Corridor San Rafael Funding Agreement. Identification of design and zoning recommendations to achieve the community's vision for transit oriented development and affordable housing in the station area. • Station Access and Connectivity. A study area site plan showing the recommended improvements for safe and feasible access to the SMART station by pedestrians, the disabled, and bicyclists. • Accessible Design. An analysis of accessible design improvements and provide recommendations consistent with MTC's accessible design policies. • Pedestrian -Friendly Design. Recommendations necessary to create a pedestrian -friendly street and fagade design consistent with a walkable TOD environment. • Parking. Recommendations to meet parking demand (e.g., parking district, revised pricing, unbundling parking, shared parking, etc.) to support existing uses and future commercial and residential development. • Implementation Plan. Summarize in a multiagency implementation plan the above recommendations. Include a phasing plan for actions and financing options. RECIPIENT's implementation plan shall include specific facility and infrastructure improvements on the City's right-of-way in the vicinity of the SMART station, recommended priorities, estimated costs for design and construction, and estimated costs and sources of funding and timelines. The primary objectives to be accomplished as part of the Station Area planning process are to: 1. Design an integrated transit complex, with each station working well individually and as a whole 2. Improve functionality of the bus hub, including the transfer system 3. Leverage investments to maximize riders for all transit agencies 4. Improve access for pedestrians and bicyclists using the transit hub 5. Maximize opportunities for adjacent land uses 6. Manage traffic operations and safety for all modes at this key Marin County circulation point 7. Design an attractive public facility that is an integral part of the fabric of Downtown 8. Leverage the new rail station for housing and economic development in Downtown MTC/San Rafael Funding Agreement Downtown and Civic Center Station Area Plans Page 5 Communitv Involvement Strate2v In San Rafael, community-based governance is embedded in the General Plan. Two community meetings will be held to identify opportunities and challenges, and for feedback on the draft ideas. Focus group meetings shall be held with agency committees to ensure wide representation. These will be regular `loop out' presentations to the various agency advisory committees (in San Rafael: RDA CAC, Bicycle/Pedestrian Committee, ADA Committee; for Golden Gate: Bus Passengers Advisory Committee, Advisory Committee on Accessibility, Service Review Committee; for SMART: Design Coordination Committee). City staff will work with community-based organizations such as Canal Alliance and the Canal Welcome Center to loop out to traditionally -underrepresented populations, such as Spanish-speaking transit users. These loop outs will occur periodically to share progress and receive feedback on project. In addition, project team staff will loop out periodically to the various agency boards, including the San Rafael Planning Commission and the City Council, the Marin Transit Agency board, and the SMART Board to share progress and the Draft Plan. In addition, so that there will be a collaborative approach to resolving issues, a technical advisory committee, or "Joint Project Committee," of funding partners will meet regularly for updates and to review draft documents. Pro ect g eporrt Mama' even' ck o Project Management The Station Area Plan project involves six agencies, including the RECIPIENT, the San Rafael Redevelopment Agency, SMART, Golden Gate Transit, Marin Transit, and the Transportation Authority of Marin. Several strategies will ensure strong coordination and timely communication: ■ The Project Steering Committee (SC) comprises the executive directors of the agencies. This group will meet periodically to monitor progress and resolve any interagency issues. ■ The Joint Project Team (JPT) includes at least one staff from each funding agency and from the Association of Bay Area Govermnents (ABAG). This `technical advisory committee' will meet monthly to track progress, review draft documents, and provide direction and recommendations on project tasks. o A subcommittee of the JPT includes a staff person from each agency, and is charged with developing draft materials for the JPT's consideration. o Each agency representative to the JPT is responsible for communicating with its own agency staff about the project and issues that need to be resolved. The RECIPIENT or RECIPIENT's consultant be responsible for facilitating JPT meetings and attending approximately two SC meetings, two community workshops, two meetings each of the City Council, SMART board, Golden Gate Board and the Marin Transit board, and two community outreach/"loop out" meetings as needed. The RECIPIENT or RECIPIENT's consultant shall prepare a map of the proposed project area depicting the existing conditions. The map will show streets, buildings, parking areas, bike paths and trails and public and quasi -public facilities. The RECIPIENT or RECIPIENT's consultant shall assemble the existing data, map of existing conditions, land use and housing analysis, etc. into a Background Report with chapters depicting relevant information about the Station Area. Components include: 1.8 SMART station design (summer 2010, 20% design) [in kind] /rail configuration: tracks and grade crossings, signal coordination, gate arm signals, (location for vehicular and pedestrian crossings along 4`h, 3rd, 2nd streets; and ped crossing between Yd and 2nd streets), identification of permitted traffic movements during deployment of gate arms, and station location/footprint/design, surveys; 1.9 Base maps (topographic, aerial, etc.) and related information (property ownership), housing 1.10 Review previous studies, including but not limited to SMART's environmental reports, San Rafael General Plan 2020, San Rafael Bicycle and Pedestrian Plan Master Plan, Canalfront Conceptual Design Plan, MTC policies on accessible design', MTC study recommendations on pedestrian way finding and circulation for the San Rafael Transit Center, and Marin Transit studies; 1.11 Existing Bettini Station conditions/bus operations, including passenger transfer volumes between platforms and loading area. 1.12 Existing roadway/pedestrian/bicycle conditions. Existing and Projected Rail and Bus Transit, Taxi and Bicycle operations: - SMART (anticipated service schedules) - Golden Gate Transit - Marin Transit Shuttles - West Marin Stagecoach - Civic Center County Shuttle - Marin Airporter I The MTC Commission recently adopted the following policies that need to be included in the Station Area Plan: Accessible design will ensure visitable and habitable TOD housing for persons with disabilities, particularly to ensure that 10% of new townhomes be habitable by persons with disabilities and that accessible paths of travel be planned for from the TOD developments within one-half mile of the SMART station. Describe and review the zoning in the project area to identify current housing potential. San Rafael's inclusionary housing ordinance requires that 20 percent of new housing be affordable to low- and moderate -income households for ownership projects, and to very low- and low-income households for rental projects. General Plan policy requires that the units be integrated into the proposed project, and similar to the market rate units in type and size. The study area is already zoned for Transit Oriented Development (TOD) projects. A wide variety of retail, office and residential uses are allowed. Evaluate at least two sites for housing and mixed use opportunities and possibilities. The evaluation will identify any existing incompatible land uses in the study area, and any impacts of potential development on schools and parks. The evaluation will be shared at the Community Workshop for public feedback on housing and economic development opportunities. 1.15 Parking supply and demand, existing conditions. The RECIPIENT or RECIPIENT's consultant shall conduct a parking demand analysis to assess the parking demand for the project area and potential for new parking. The study will include: • Anticipated residential parking demand; • Anticipated employment/commercial and event parking demand; • Potential for shared parking, additional parking and priced parking in station vicinity; • Potential for priced parking in station area; 1.16 Identify/quantify physical and operational impacts of SMART and the new transit complex to all modes 1.17 Preparation of Background Report incorporating above information and analysis. Deliverable #1: Downtown San Rafael Station Area Plan Background Report :Task 2: CoM'Muni Workshop,M : Visioning After the completion of the Background Report, the RECIPIENT or RECIPIENT's consultant shall conduct Community Workshop #1. The Community Workshop will serve as a forum for the community to learn about the project, the project area, circulation, parking & related land use background, and to identify issues and envision possible improvements. Agency staff and the RECIPIENT or RECIPIENT's consultant shall review the background report, educate the public on concepts of TOD and the status of station plan development, provide examples of successful TOD projects, and describe the circulation analysis findings and the parking study analysis. The recently -developed California Pedestrian Safety Assessment Program or similar approach will help the community identify barriers to pedestrian access and safety. The community will brainstorm issues, concerns and challenges, as well as envision possible improvements and opportunities for changes for the better. This forum may include individuals from the development community and/or transit agencies who have been involved in the successful development of transit villages. 2.1 Workshop preparation (display visuals, workshop materials, powerpoint show) 2.2 Conduct outreach and publicity about the workshop 2.3 Conduct Community Workshop (site, facilitator recruitment and training, recording) MTC/San Rafael Funding Agreement Downtown and Civic Center Station Area Plans Page 9 2.4 Prepare Workshop summary, including workshop displays and photos of the event Deliverable #2: Downtown San Rafael Station Area Plan Community Workshop #1 Summary T ask 3: ,alternative Scenarios The introduction of SMART rail service through the Bettini station necessitates a re-examination of the physical design of the overall Transit Center, including integration of the existing Transit Center with the future SMART station, and of operation of the Transit Center. With this redesign, come opportunities for improved overall transit service and access and potential joint TOD development. For example, bus bay space could be provided elsewhere (an alternative in SMART's EIR), or land could be used to provide bus services and redeveloped with housing. Attention will be given to addressing pedestrian safety concerns for transit users traversing areas between the two stations. Land use opportunities will be evaluated for traffic impacts, positive community impacts, and impacts of displacement of existing residents. 3.1 Prepare maximum of two housing alternatives on a minimum of two sites. 3.2 Prepare maximum of four circulation and housing/land use alternatives (operations of all modes, access, housing). 3.3 Determine impacts on all modes, access, parking and housing 3.4 Conduct and evaluate alternatives (transit, taxi, auto, non -motorized, housing) 3.5 Parking (projected demand) and recommendations (shared location). The best practices in MTC's Toolbox/Handbook: Parking Best Practices and Strategies for Supporting Transit Oriented Development in the San Francisco Bay Area will be reviewed for applicability in the Downtown station area. The parking options will include recommendations to help meet the possible demand for additional parking in the vicinity of the SMART station, and for zoning amendments for appropriate parking standards in the vicinity of the rail station. 3.6 Selection of 2 scenario(s) for public review Deliverable #3: Downtown Station Area Plan Alternative Scenarios Report Task 4: Community Workshoo 42: Building a Shared Vision After the completion of the Workshop Report, the RECIPIENT or RECIPIENT's consultant shall conduct Community Workshop #2. The Community Workshop will serve as a forum for the community to provide input about the options for improvements for accessibility, parking, housing and mitigations for impacts in the study area. 4.1 Workshop preparation (visual displays, PowerPoint) 4.2 Conduct outreach and publicity about the workshop 4.3 Conduct Community Workshop (site, facilitator recruitment and training, recording) 4.4 Prepare Workshop summary, including workshop displays and photos of the event Deliverable #4: Downtown San Rafael Station Area Plan Community Workshop #2 Summary MTC/San Rafael Funding Agreement Downtown and Civic Center Station Area Plans Page 10 Task 5: Draft Downtown San Rafael Station Area Plan The RECIPIENT or RECIPIENT's consultant shall develop a draft Downtown Station Area Plan for public review. The Draft Station Area Plan will encompass findings and information from above tasks, and shall include at a minimum the following elements: The Draft Downtown Station Area Plan shall include at a minimum the following elements: 1. The Planning Process. Description of the public involvement process used to engage community stakeholders and members of the public; 2. Vision for the Station. Description of the character of transit complex and the surrounding area, as envisioned by the community. 3. Housine/Land Use. Identification of design and zoning recommendations to achieve the community's vision for transit oriented development and affordable housing in the station area. Identify mitigations for any incompatible land uses and for any impacts on schools and parks. 4. Station Access and Connectivitv. Include a study area site plan showing the recommended improvements for safe and feasible access to the SMART station by pedestrians, the disabled, and bicyclists. Specific topics include: ■ Pedestrian crossings from the SMART rail station to the bus transit station ■ Drop off and pick up areas ■ Bus circulation and transfer patterns ■ State-of-the-art design standards to facilitate circulation for seniors and people who are physically impaired. Describe and list in priority public improvements to increase pedestrian safety and comfort, and to encourage access to transit. Improvements may include (but not be limited to) wayfinding signage, improved crosswalks, improved lighting, landscaping and other amenities. Include strategies to improve the safety and usability of access paths/routes to bus and rail stations for pedestrian, bicycle, and auto users. Additionally, enhance multimodal connections between the transit stations and surrounding neighborhoods, and integrate designs with streets, pedestrian & bike access improvements. 5. Accessible Design — Include an analysis of accessible design improvements and provide recommendations consistent with MTC's accessible design policies. The transit center complex is in the immediate vicinity of the Marin Center for Independent Living and Whistlestop (a facility and people who are disabled). This analysis may be included in the Station Access and Connectivity Plan described above. 6. Pedestrian-Friendlv Design. Include recommendations necessary to create a pedestrian - friendly street and fagade design consistent with a walkable TOD environment. 7. Parking. Include recommendations to meet parking demand (e.g., parking district, revised pricing, unbundling parking, shared parking, etc.) to support existing uses and future commercial and residential development. 8. Implementation Plan. Summarize in a multiagency implementation plan the above recommendations. The RECIPIENT and agency partners shall loop out with focus group meetings with agency advisory committees to seek public input on the draft plan. 5.6 Agency review of draft plan Deliverable #S: Draft Downtown San Rafael Station Area Plan (including Implementation Plan) Task 6: Prepare Final Downtown Sau''Rafael,�`tation urea Plaa'' Following focus group review, the RECIPIENT or RECIPIENT's consultant, in consultation with the JPT, shall develop a final Downtown San Rafael Station Area Plan. The RECIPIENT shall receive the final plan with a recommendation to accept the plan with intentions to proceed with the implementation plan as funding becomes available. The San Rafael City Council will receive the plan at a regular meeting, hold a public hearing, and adopt a resolution to accept the plan and direct staff to consider for future general plan and zoning amendments, and to pursue funding for capital improvements. Other members of the Joint Project Team will present the final plan to their respective boards for acceptance and recommendation to proceed with applicable recommendations of the implementation plan. 6.1 Prepare final Downtown San Rafael Station Area Plan 6.2 Present final Plan to agencies 6.3 Print final copies of the Plan for distribution Deliverable #6a: Final Downtown San Rafael Station Area Plan Deliverable #6b: City Council resolution accepting the Station Area Plan MTC/San Rafael Funding Agreement Downtown and Civic Center Station Area Plans Page 12 Civic Center Station Area Plan: Scope of Work RECIPIENT shall develop a Station Area Plan that includes: 1) Design guidelines and zoning recommendations to maximize housing potential. 2) A Station access and connectivity plan for safe and comfortable pedestrian and bicycle access to the station from the surrounding uses (particularly Marin County Civic Center and Northgate Mall), and the integration of the new rail station into the North San Rafael Promenade. This plan would also include components for accessibility for people with disabilities, working closely with Guide Dogs for the Blind, which is in the immediate vicinity to the station. In addition, the plan would include recommendations for pedestrian -friendly improvements for the study area. 3) A Parking & Access Study to assess parking supply and demand and appropriate vehicular access and management strategies. An implementation plan will include specific facility and infrastructure improvements on the properties in the vicinity of the SMART station, recommended priorities, estimated costs for design and construction, and estimated costs and sources of funding and timelines, as well as recommended design guidelines (and zoning amendments if recommended). The primary objectives to be accomplished as part of the Station Area planning process are to: 1. Design an integrated transit complex to serve the North San Rafael community 2. Explore opportunities to establish a bus hub, with coordinated service connections 3. Leverage investments to maximize riders for all transit agencies 4. Improve access for pedestrians and bicyclists using the transit center 5. Maximize opportunities for adjacent land uses 6. Identify alternatives on how to manage the impacts of vehicular traffic 7. Design an attractive station area that is an integral part of the fabric of North San Rafael 8. Leverage the new rail station for housing and economic development in North San Rafael The project area is the Civic Center/North San Rafael Town Center Priority Development Area (PDA.). Within the PDA, the study area for the Station Area Plan is outlined in red below: Communitv Involvement Strateev In San Rafael, community-based governance is embedded in the General Plan. For this project, a broad-based Station Advisory Committee (SAC) would provide oversight of the development of the recommendations. The SAC will the north San Rafael community in discussions about how best to integrate the SMART station into the fabric of the existing community. The SAC will have approximately 11 members not including ex officio members; the SAC will include traditionally -underrepresented populations, such as renters and low income residents. Solicit invitations to apply, interviews will be held as needed, and the San Rafael City Council will make appointments. The committee will meet regularly (monthly if needed) to review background information, host workshops, review analysis and evaluation of potential improvements, and make final recommendations. The Steering Committee's charge for the SAC is to: MTC/San Rafael Funding Agreement Downtown and Civic Center Station Area Plans Page 13 ■ Prepare a Civic Center Station Plan that will address Station Access and Connectivity; Transit Oriented Development; Accessible Design; Parking; and Pedestrian Design. ■ Use area resources and assets to build on the design and engineering work for SNL RT's Civic Center station to create a functional and attractive transit hub for the north San Rafael community. ■ Include a multiagency implementation plan that summarizes the plan's recommendations and includes a phasing plan for actions and financing options for the responsible agencies. Tasks below describe two community meetings that will be held to identify opportunities and challenges, and for feedback on the draft ideas. As needed, focus group meetings will be held with community groups to ensure representation of under -represented populations. In addition, project team staff will loop out periodically to the various agency boards, including the San Rafael Planning Commission and the City Council, the County Board of Supervisors, the Marin Transit Agency Board, and the SMART Board to share progress and the Draft Plan. In addition, so that there will be a collaborative approach to resolving issues: a technical advisory committee ("Joint Project Committee") of funding partners that will meet regularly for updates and to review draft documents. Several strategies will ensure strong coordination and timely communication: ■ The Project Steering Committee (SC) comprises the executive directors of the agencies. This group will meet periodically to monitor progress and resolve any interagency issues. ■ The Joint Project Team (JPT) includes at least one staff from each funding agency and from the Association of Bay Area Governments (ABAG). This `technical advisory committee' will meet monthly to track progress, review draft documents, and provide direction and recommendations on project tasks. o A subcommittee of the JPT includes a staff person from each agency, and is charged with developing draft materials for the JPT's consideration. o Each agency representative to the JPT is responsible for communicating with its own agency staff about the project and issues that need to be resolved. The RECIPIENT or RECIPIENT'S consultant shall prepare a map of the proposed project area depicting the existing conditions. The map will show streets, buildings, parking areas, bike paths and trails, transit stop locations, and public and quasi - public facilities. The CONSULTANT shall assemble the existing data, map of existing conditions, land use and housing analysis, etc. into a Background Report with chapters depicting relevant information about existing conditions in the Station Area. Components include: 7.8 SMART Station design (Summer 2010, 20% design) [in kind]/Rail configuration: tracks and grade crossings, signal coordination, gate arm signals, and station location/footprint/ design, surveys, bus and shuttle drop off areas 7.9 Base maps (topographic, aerial, etc.) and related information (property ownership), housing 7.10 Review previous studies, including but not limited to SMART's environmental documents, County of Marin's parking study, Marin Center Renaissance Partnership Project, Vision North San Rafael, North San Rafael Promenade Design Features, San Rafael General Plan 2020, San Rafael Bicycle and Pedestrian Plan Master Plan, Marin Transit Studies, MTC policies on accessible design'; 7.11 Existing roadway/pedestrian/bike conditions. Existing and Projected Transit, Taxi and Bicycle operations: - Golden Gate Transit - Marin Transit Shuttles - Civic Center County Shuttle - SMART shuttles - Taxis - Bicycle routes - Bicycle parking 7.12 Collect existing traffic data; conduct and observe operations, as needed. Existing level - of -service for all modes, queue and delay analysis at the following intersections: - Freitas & 101 NB - Freitas & Del Presidio - Freitas & Las Gallinas - Freitas & Northgate ' The MTC Commission recently adopted the following policies that need to be included in the Station Area Plan: Accessible design will ensure visitable and habitable TOD housing for persons with disabilities, particularly to ensure that 10% of new townhomes be habitable by persons with disabilities and that accessible paths of travel be planned for from the TOD developments within one-half mile of the SMART station. San Pedro from Merrydale to Civic Center - Northgate from Los Ranchitos to Freitas Identify additional delay to all modal operations in study area: - Due to CPUC full -stop requirements for buses at at -grade crossings - Due to CPUC requirements for deployment of gates prior to arrival, following departure and during station dwell time; - Along access routes - Along egress routes 7.13 Parking supply and demand, existing conditions. The RECIPIENT or RECIPIENT's consultant shall conduct a parking demand analysis to assess the parking demand for the project area and potential for new parking. The study will include: - Anticipated residential parking demand; - Anticipated employment/commercial and event parking demand; - Potential for additional parking, shared parking, and priced parking in vicinity. 7.14 Land uses/zoning for housing, existing, and background and initial evaluation of housing opportunity sites. San Rafael's inclusionary housing ordinance requires that 20 percent of new housing be affordable to low- and moderate -income households for ownership projects, and to very low- and low-income households for rental projects. General Plan policy requires that the units be integrated into the proposed project, and similar to the market rate units in type and size. To the west of the SMART station are two ministorage facilities. General Plan policy calls for review of the land use designations for these sites so that TOD development can be encouraged near the rail station. The North San Rafael Town Center area also has sites where potential infill housing may be possible. [NOTE: Marin County Civic Center will not be one of the sites studies.] Describe and review general plan affordable housing policies and the zoning in the project area to identify current housing potential. The evaluation will identify any existing incompatible land uses in the study area, and any impacts of potential development on schools and parks. 7.15 Identify/Quantify Physical and Operational Impacts of SMART at the new transit station to all modes 7.16 Preparation of Background Report incorporating above information and analysis. The Community Workshop will serve as a forum for the community to learn about the project, the project area, circulation, parking & housing background, and to envision possible improvements. JPT staff and the RECIPIENT or RECIPIENT's consultant shall present the background report, educate the public on concepts of TOD and the status of station plan development, provide examples of successful TOD projects, and describe the circulation analysis findings and the parking study analysis. The recently -developed California Pedestrian Safety Assessment Program or similar approach will help the community identify barriers to pedestrian access and safety. The community will brainstorm issues, concerns and challenges, as well as envision possible improvements and opportunities for changes for the better. This forum may include individuals from the development community and/or transit agencies who have been involved in the successful development of transit villages. 8.1 Workshop preparation (display visuals, workshop materials, PowerPoint show) 8.2 Conduct outreach and publicity about the workshop 8.3 Conduct Community Workshop (site, facilitator recruitment and training, recording) 8.4 Prepare Workshop summary, including workshop displays and photos of the event Deliverable #8: Civic Center Station Area Plan Community Workshop #1 Summary The introduction of SMART rail service in north San Rafael offers opportunities for improved overall transit service and access and potential joint TOD development. Attention will be given to addressing pedestrian safety concerns for transit users. The housing opportunities will be evaluated for traffic and community impacts, and impacts of displacement of existing residents with redevelopment. 9.1 Prepare maximum of four circulation alternatives with at least two housing sites/land use alternatives (operations of all modes, access, housing). 9.2 Analysis and evaluation of alternatives on all modes including transit, taxi, auto, non - motorized, and on housing. 9.3 Parking (projected demand) and recommendations (shared, location). The best practices in MTC's Toolbox/Handbook: Parking Best Practices and Strategies for Supporting Transit Oriented Development in the San Francisco Bay Area will be reviewed for applicability in the Civic Center station area. The parking options will include recommendations to help meet the possible demand for additional parking near the SMART station, and for zoning amendments for appropriate parking standards in the vicinity of the rail station. 9.4 Selection of 2 scenario(s) for public review Deliverable #9: Civic Center Station Area Play: Alternative Scenarios Report MTC/San Rafael Funding Agreement Downtown and Civic Center Station Area Plans Page 17 After the completion of the Workshop Report, the RECIPIENT or RECIPIENT's consultant shall conduct Community Workshop #2. The draft plan will encompass findings and information from above tasks. The draft plan shall include at a minimum the following elements: 1. The Planning Process. Description of the public involvement process used to engage community stakeholders and members of the public; 2. Vision for the Station. Description of the desired character and preferred improvements in the area, as envisioned by the community. 3. Housing/Land Use. Identification of design and zoning recommendations to achieve the community's vision for transit oriented development and affordable housing in the station area. Identify mitigations for any incompatible land uses and for any impacts on schools and parks. 4. Station Access and Connectivitv. Include a study area site plan showing the recommended improvements. Specific topics include: • Barriers to pedestrian and bicycle access to Transit Station, and east/west across Highway 101 • Drop off/pick up areas • Bus stop locations for Marin Transit and SMART shuttle services in the study area. Describe and list in priority public improvements to increase pedestrian comfort and safety and encourage access to transit. Improvements could be wayfinding signage, improved lighting, landscaping and other amenities. 5. Accessible Design — Include an analysis of accessible design improvements and provide recommendations consistent with MTC's accessible design policies. The Civic Center SMART station is in the immediate vicinity of the nationally -renowned Guide Dogs for the Blind campus. The campus provides a unique opportunity to design state-of-the-art accessibility for the blind. This analysis may be included in the Station Access and Connectivity Plan described above. 6. 6Pedestrian-Friendlv Design Standards — Include design guidelines to support a walkable TOD environment, such as provisions for pedestrian -friendly street and fagade design and pedestrian -related improvements. Parkiniz - Include recommendations to meet the possible demand for additional parking near the SMART station, and for zoning amendments for appropriate parking standards in the vicinity of the rail station. 8. Implementation Plan--- Summarize in a multiagency implementation plan the recommendations above. Include a phasing plan for actions and financing options. 11.1 Refinement of final recommendations 11.2 Traffic impact analysis 11.3 Draft multiagency Implementation Plan 11.4 Prepare Draft Civic Center Plan 11.5 Conduct Focus Group reviews of draft plan. The RECIPIENT and agency partners, through the SAC, shall conduct focus group meetings to seek public input on the draft plan. 11.6 Agency review of draft plan Deliverable #11: Draft Civic Center Station Area Plan (including Implementation Plan) Following focus group review, the RECIPIENT or RECIPIENT's consultant, in consultation with the JPT, shall develop a final Civic Center Station Area Plan. The RECIPIENT shall receive the final plan with a recommendation to accept the plan with intentions to proceed with the implementation plan as funding becomes available. The San Rafael City Council will receive the plan at a regular meeting, hold a public hearing, and adopt a resolution to accept the plan and direct staff to consider for fixture general plan and zoning amendments, and to pursue funding for capital improvements. Other members of the Joint Project Team will present the final plan to their respective boards for acceptance and recommendation to proceed with applicable recommendations of the implementation plan. 12.1 Prepare final Civic Center Plan 12.2 Present final plan to agencies 12.3 Print final copies of the Plan for distribution Deliverable #12a: Final Civic Center Station Area Plan Deliverable #12b: City Council resolution accepting the Station Area Plan MTC/San Rafael Funding Agreement Downtown and Civic Center Station Area Plans Page 21 ATTACHMENT C TERMS AND CONDITIONS 1. FUNDING Funding from DOT shall be contingent upon approval by the Federal Highway Administration (FHWA) of MTC's Overall Work Program ("OWP'). Should DOT amend the OWP after the effective date of this Agreement to reduce the amount of available STP funds, MTC will reduce RECIPIENT's share of STP funds proportionately and shall, after consultation with the RECIPIENT, amend the Scope of Work as necessary to reflect the reduced level of funding. 2. AMENDMENTS Any changes in the activities to be performed under this Agreement shall be incorporated in written amendments, which shall specify the changes in work performed and any adjustments in compensation and schedule. All amendments shall be executed by the MTC Executive Director or a designated representative and RECIPIENT. No claim for additional compensation or extension of time shall be recognized unless contained in a duly executed amendment. 3. TERMINATION MTC may terminate this Agreement without cause upon ten (10) days prior written notice. If MTC terminates this Agreement without cause, RECIPIENT will be entitled to payment for costs incurred for incomplete deliverables, up to the maximum amount payable for each deliverable. If RECIPIENT fails to perform as specified in this Agreement, MTC may terminate this Agreement for cause by written notice and RECIPIENT will be entitled only to costs incurred for work product acceptable to MTC, not to exceed the maximum amount payable under this Agreement for such work product. 4. RETENTION OF RECORDS RECIPIENT agrees to keep all records pertaining to the project being funded for audit purposes for a minimum of three (3) years following final payment to RECIPIENT or four (4) years following the fiscal year of the last expenditure under this Agreement, whichever is longer, in accordance with generally accepted accounting principles. Copies of RECIPIENT audits, if any, performed during the course of Project development and at Project completion shall be forwarded to MTC no later than one hundred eighty (180) days after fiscal year end close. 5. AUDITS RECIPIENT agrees to grant MTC, or any agency that provides MTC with funds for the Project, including but not limited to, the U.S. Department of Transportation, FHWA, the Comptroller General of the United States, the State, and their authorized representatives access to RECIPIENT's books and records for the purpose of verifying that funds are properly accounted for and proceeds are expended in accordance with the terms of this Agreement. All documents shall be available for inspection during normal business hours at any time while the Project is underway and for the retention period specified in Article 4. RECIPIENT further agrees to include in all its third -party contracts hereunder a provision to the effect that the contractor agrees that MTC, the U.S. Department of Transportation, FHWA, MTC/San Rafael Funding Agreement Downtown and Civic Center Station Area Plans Page 22 the Comptroller General of the United States, the State, or any of their duly authorized representatives shall have access to and the right to examine any directly pertinent books, documents, papers, and records of such subcontractor, during normal business hours, for the term specified above. The term "contract" as used in this clause excludes agreements not exceeding $25,000. 6. LICENSE TO WORK PRODUCTS RECIPIENT hereby grants to MTC an irrevocable, non-exclusive, royalty -free license to use without restriction and share with any person or entity all drawings, designs, specifications, manuals, reports, studies, surveys, models, software, source code and source code documentation, documentation or system architecture, and any other documents, materials, data, and products ("Work Products") developed, prepared, or assembled by RECIPIENT or RECIPIENT's consultant(s) or its subconsultants pursuant to this Agreement. MTC may exercise their licenses to Work Products through sublicenses to a third party, without the approval of RECIPIENT or RECIPIENT's consultant(s) or subconsultants. FHWA reserves a royalty -free, non-exclusive and irrevocable license to reproduce, publish or otherwise use, and to authorize others to use, for federal government purposes: (a) the copyright in any work developed under this Agreement; and (b) any rights of copyright to which RECIPIENT or RECIPIENT's consultant(s) or subconsultants purchase ownership under this Agreement. 7. EQUAL EMPLOYMENT OPPORTUNITY In accordance with Title VI of the Civil Rights Act, as amended (42 U.S.C. § 2000d); Section 303 of the Age Discrimination Act of 1975, as amended (42 U.S.C. § 6102); Section 202 of the Americans with Disabilities Act of 1990 (42 U.S.C. § 12132); and 49 U.S.C. § 5332 for FTA -funded projects, RECIPIENT agrees that it will not, on the grounds of race, religious creed, color, national origin, age, physical disability or sex, discriminate or permit discrimination against any employee or applicant for employment. 8. DISADVANTAGED BUSINESS ENTERPRISES (DBE) It is the policy of MTC and the U.S. Department of Transportation to ensure nondiscrimination in the award and administration of DOT -assisted contracts and to create a level playing field on which disadvantaged business enterprises, as defined in 49 Code of Federal Regulations Part 26, can compete fairly for contracts and subcontracts relating to MTC's procurement and professional services activities. RECIPIENT shall not discriminate on the basis of race, color, national origin or sex in the performance of this Agreement. RECIPIENT shall carry out applicable requirements of 49 CFR Part 26 in the award and administration of DOT -assisted contracts. Failure by RECIPIENT to carry out these requirements is a material breach of contract, which may result in the termination of this agreement or such other remedy as MTC deems appropriate. 9. TITLE VI OF THE CIVIL RIGHTS ACT OF 1964 RECIPIENT agrees to comply with all the requirements imposed by Title VI of the Civil Rights Act of 1964 (47 U.S.C. § 2000(d)) and the regulations of the Department of Transportation issued thereunder (49 CFR Part 21). ACCESS REQUIREMENTS FOR INDIVIDUALS WITH DISABILITIES RECIPIENT agrees to comply with all applicable requirements of the Americans with Disabilities Act of 1990 (ADA), 42 U.S.C. § 12101 et seq.; Section 504 of the Rehabilitation Act of 1973, as amended, 29 U.S.C. § 794; Section 16 of the Federal Transit Act, as amended, 49 U.S.C. § 5310(f); and their implementing regulations. 11. STATE ENERGY CONSERVATION PLAN RECIPIENT shall comply with all mandatory standards and policies relating to energy efficiency that are contained in the State energy conservation plan issued in compliance with the Energy Policy and Conservation Act (42 U.S.C. § 6321). 12. DEBARMENT RECIPIENT certifies that neither it, nor any of its participants, principals or subcontractors is or has been debarred, suspended, proposed for debarment, declared ineligible, or voluntarily excluded from covered transactions, as they are defined in 49 CFR Part 29, by any Federal agency or department. 13. CLEAN AIR AND WATER POLLUTION ACTS RECIPIENT agrees to comply with the applicable requirements of all standards, orders, or requirements issued under the Clean Air Act (42 U.S.C. § 7501 et seq.), the Clean Water Act (33 U.S.C. § 1251 et seq.), Executive Order 11738, and Environmental Protection Agency regulations (40 CFR Part 15). 14. LOBBYING RECIPIENT agrees to comply with the restrictions on the use of federal funds for lobbying activities set forth in 31 United States Code §1352 and 49 C.F.R. Part 20. 15. INDEMNIFICATION RECIPIENT shall indemnify and hold harmless MTC, Caltrans, their Commissioners, Directors, officers, agents and employees from any and all claims, demands, suits, loss, damages, injury and/or liability (including any and all costs and expenses in connection therewith), incurred by reason of any negligent or otherwise wrongful act or omission of RECIPIENT, its officers, directors, employees, agents and contractors, or any of them, under or in connection with this Agreement; and RECIPIENT agrees at its own cost, expense and risk to defend any and all claims, actions, suits, or other legal proceedings brought or instituted against MTC, Caltrans, their Commissioners, Directors, officers, agents, and employees, or any of them, arising out of such act or omission, and to pay and satisfy any resulting judgments. 16. MEETINGS RECIPIENT agrees to invite the MTC Contract Manager and the Project Manager to participate in all meetings held in connection with this project, including public meetings and project team meetings. 17. COMPLIANCE WITH LAWS RECIPIENT shall comply with any and all laws, statutes, ordinances, rules, regulations or requirements of the federal, state, or local government, and any agency thereof, including, but not limited to MTC, the U.S. DOT, FHWA, and Caltrans, which relate to or in any manner affect the MTC/San Rafael Funding Agreement Downtown and Civic Center Station Area Plans Page 24 performance of this Agreement. Those laws, statutes, ordinances, rules, regulations, and procedural requirements that are imposed on MTC as a recipient of federal or state funds are hereby in turn imposed on RECIPIENT (including, but not limited to, 49 CFR Part 18, "Uniform Administrative Requirements for Grants and Cooperative Agreements to State and Local Governments"), and are herein incorporated by this reference and made a part hereof. In addition, RECIPIENT certifies that the RECIPIENT and it's contractors shall comply with the requirements of the California Environmental Quality Act (CEQA), California Public Resources Code Section 21,000 et seq. and with the State Environmental Impact Report Guidelines (14 California Code of Regulators Section 15000 et seq.) and the National Environmental Policy Act (NEPA), 42 U.S.C. Section 4-1 et seq. and the applicable regulations thereunder. 18. IDENTIFICATION OF DOCUMENTS RECIPIENT will ensure that all documents related to the project including meeting notices and reports state that the project is funded through the Metropolitan Transportation Commission's Station Area Planning Program. In addition, RECIPIENT will ensure that all reports and other documents completed as part of this Agreement shall carry the following notation on the front cover or title page: "The preparation of this report has been financed in part by grants from the U.S. Department of Transportation. The contents of this report do not necessarily reflect the official views or policy of the U.S. Department of Transportation." 19. SUBCONTRACTS RECIPIENT must include provisions of this Agreement, as applicable, modified only to show the particular contractual relationship, in any third -party contracts funded by this Agreement.
