HomeMy WebLinkAboutCC Resolution 12957 (Twilight Criterium)RESOLUTION NO. 12957 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE TEMPORARY CLOSURE OF CITY STREETS FOR THE SAN RAFAEL TWILIGHT CRITERIUM ON SATURDAY, JULY 10, 2010 FROM 12 NOON TO 10:00 P.M. WHEREAS, the San Rafael Twilight Criterium necessitates the temporary closure of city streets as noted: 1. Fourth Street from Lootens Place to "A" Street (Expo Area) (12 noon to 10:00 p.m.) 2. Fourth Street from "A" Street to "D" Street (1:00 p.m. to 9:30 p.m.) 3. Fifth Avenue from Court Street to "D" Street (1:00 p.m. to 9:30 p.m.) 4. "B" Street from Third Street to Mission Avenue (1:00 p.m. to 9:30 p.m.) 5. "C" Street from Third Street to Mission Avenue (1:00 p.m. to 9:30 p.m.) 6. "D" Street from Third Street to Fifth Avenue (1:00 p.m. to 9:30 p.m.) WHEREAS, after reviewing plans for the event and the traffic patterns, City staff has determined and recommended that, in the interest of the safety and welfare of pedestrian and auto traffic, the above streets in the Downtown area should be temporarily closed to through traffic for the date and times described above. WHEREAS, in accordance with the Downtown Vision and by request of the Downtown Business Improvement District (BID), a limited sidewalk sale could bolster retail activities, promote event activities and add visual interest Downtown; THEREFORE IT IS HEREBY RESOLVED THAT THE CITY COUNCIL OF THE CITY OF SAN RAFAEL FINDS AS FOLLOWS: 1. That all of the above findings are true and correct; 2. That, pursuant to the authority of Vehicle Code section 21101(e), for the safety and protection of persons, both pedestrians and vehicle drivers, the City Council hereby authorizes the temporary closure of the above listed streets for the date and times described above. FURTHER, IT IS HEREBY RESOLVED that a sidewalk sale be approved for the Downtown Business Improvement District with the following parameters: 1. Only those merchants with written agreements with the City may have activities on the sidewalk; 2. Any activity would be associated with the adjacent retail space and not extend in front of another retail space; 3. The operation of an activity on the sidewalk is limited to the 9th and 10`h of July 2010 from 9am to 9pm and does not confer the right to continue operation beyond that time; 4. Participation in the program does not eliminate the need to secure any other required permit such as a business license or County Health Department permit. I, ESTHER C.
