A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL AUTHORIZING EXECUTION OF THE RIGHT-OF-WAY
CONTRACT WITH JOSEPHINE MOSK, TRUSTEE, FOR THE
PURCHASE OF A PORTION OF PROPERTY LOCATED AT 115
BELLAM BOULEVARD FOR RIGHT OF WAY PURPOSES IN
CONNECTION WITH THE SIDEWALK IMPROVEMENTS ON
BELLAM BOULEVARD AND FRANCISCO BOULEVARD EAST AS
PART OF I-5801HIGHWAY 101 CONNECTOR PROJECT, AND
AUTHORIZING ACCEPTANCE OF THE EASEMENT DEED FOR
SUCH PROPERTY.
BE IT RESOLVED by the Council of the City of San Rafael as follows:
WHEREAS, additional funds were identified to include sidewalk improvements
along Bellam Blvd. between Kerner and EB I-580 ramps and Francisco Blvd. East
between Bellam Blvd. and Vivian Way; and
WHEREAS, the City and the Transportation Authority of Marin (TAM)
cooperated to include the Francisco Blvd. East improvements identified in the Non -
Motorized Transportation Pilot Program project and additional design requirements on
Bellam into the I-580/NB101 Connector project; and
WHEREAS, additional Right -of -Way acquisition and Right of Entry/
Temporary Construction Easement is required to enhance the project construction and
final product; and public interest, convenience and welfare require that the property
hereinafter mentioned owned by JOSEPHINE MOSK, TRUSTEE of the JOSEPHINE
MOSK TRUST -2005, u/t/a dated January 17, 2005 (herein referred to as "JOSEPHINE
MOSK, TRUSTEE"), be purchased and used for the benefit of the public of the City of
San Rafael, California.
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
San Rafael that the Mayor is authorized to execute the Right -of -Way contract between
JOSEPHINE MOSK, TRUSTEE, and the City of San Rafael, a copy of which is attached
hereto, marked as Attachment "I", and incorporated herein by this reference; and
IT IS FURTHER RESOLVED by the City Council of the City of San
Rafael to accept the Easement Deed from JOSEPHINE MOSK, TRUSTEE, to the City of
San Rafael, in the form attached hereto, as Attachment "II", as approved by the City
Attorney.

foregoing resolution was duly and regularly introduced and adopted at a regular meeting of
the Council of said City on the 6`h day of July, 2010, by the following vote, to wit:
