HomeMy WebLinkAboutCC Resolution 12212 (Planning Staffing; Pacific Municipal Consultants)RESOLUTION NO. 12212 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE CITY MANAGER TO EXECUTE A SECOND AMENDMENT TO THE AGREEMENT FOR PROFESSIONAL PLANNING SERVICES WITH PACIFIC MUNICIPAL CONSULTANTS (PMC) FOR INTERIM PROFESSIONAL PLANNING STAFFING WITHIN THE CURRENT PLANNING SECTION OF THE COMMUNITY DEVELOPMENT DEPARTMENT (Agreement Term: July 10, 2006 through September 30, 2007, amount not to exceed $217,980.00) WHEREAS, on August 7, 2006, the City Council adopted Resolution No. 12009 approving an Agreement for Professional Planning Services with Pacific Municipal Consultants (PMC) for interim staffing within the Planning Division of the Community Development Department at a "not to exceed" amount of $68,000 and for a term extending from July 10, 2006 through December 10, 2006; and WHEREAS, on December 18, 2006, the City Council adopted Resolution No. 12166 approving an amendment to the Agreement for Professional Services with PMC, increasing the budget cap to $127,500.00 and extending the term of the Agreement through March 31, 2007; and WHEREAS, the City of San Rafael has determined that continued interim professional planning services are needed to provide support to the Current Planning Division of the Community Development Department during recruitment for a vacant position within the Division and training of new personnel, as well as to assist with special projects that have been deferred due to the recent staffing shortage within the Division. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of San Rafael does hereby authorize the City Manager to execute, on behalf of the City of San Rafael, a second amendment to the Agreement for Professional Planning Services with Pacific Municipal Consultants (PMC), in the form attached herewith. LEONCM, City Clerk SECOND AMENDMENT TO AGREEMENT FOR PROFESSIONAL PLANNING SERVICES This Agreement is made and entered into this 19th day of March 2007, by and between the CITY OF SAN RAFAEL (hereinafter "CITY"), and PACIFIC MUNICIPAL CONSULTANTS (PMC) (hereinafter "CONTRACTOR"). RECITALS WHEREAS, due to a staffing shortage within the Planning Division, the current workload of staff, the pace of land planning and development activity, and the need to provide training to recent appointees to the Planning Division staff, the CITY has determined that professional services are needed to supplement existing staffing during the timeframe necessary to complete the recruitment for a vacant position and training of new staff members within the Planning Division. WHEREAS, on August 7, 2006, the City Council adopted Resolution No. 12009, authorizing the execution of an Agreement between the CITY and the CONTRACTOR for professional planning services through December 10, 2006 and set forth a billing cap of $68.000.00; and WHEREAS, on December 18, 2006, the City Council adopted Resolution No. 12166, approving a first amendment to the Agreement between the CITY and the CONTRACTOR, increasing the budget cap to $127,500.00 and extending the term of the Agreement through March 31, 2007; and WHEREAS, it has been determined that the billing cap must be increased by an additional $90,480.00 to provide continued assistance to the Planning Division through September 30, 2007 to accommodate the completion of the recruitment for the vacant Assistant Planner position, to supplement staffing during the training of new appointees to the Planning Division staff and to complete work on special projects that have been delayed due to vacancies in the Division. AGREEMENT NOW, THEREFORE, the parties hereby agree to amend, the following sections of the Agreement for Professional Planning Services, approved on August 7, 2006, as follows: 4. COMPENSATION. For the full performance of the services described herein by CONTRACTOR, CITY shall pay CONTRACTOR an hourly rate of $87.00 per hour. The billing amounts authorized under this agreement shall not exceed $217,980.00 ($68,000.00 authorized under the initial Agreement, $127,500.00 authorized under the first amendment, plus an additional $90,480.00 authorized under this amendment). 03/ 19x'2007 1 ;y+t r If 5. TERM OF AGREEMENT. The term of this Agreement shall be extended until September 30, 2007. Upon mutual agreement of the parties, and subject to the approval of the City Manager and the PROJECT MANAGER the term of this Agreement may be extended. All of the other provisions, terms and obligations of the Agreement for Professional Planning Services, executed on August 7, 2006, shall remain valid and shall be in force with the execution of this amendment.
