RESOLUTION OF THE CITY COUNCIL OF SAN RAFAEL
AUTHORIZING FORBEARANCE IN THE COLLECTION OF A
PORTION OF THE APPROVED ON -STREET METERED
PARKING RATES ON FOURTH STREET IN THE WEST END
AREA OF THE CITY FROM OCTOBER 1, 2007 THROUGH
SEPTEMBER 30, 2009, OR UNTIL THE DATE OF
RECORDATION OF THE NOTICE OF COMPLETION FOR THE
FOURTH STREET WEST END VILLAGE IMPROVEMENT
PROJECT, WHICHEVER DATE IS SOONER.
WHEREAS, the City Council has approved Ordinance No. 1859 and related Resolution
No. 12318, fixing new on -street metered parking rates in the Downtown Parking Zone which
become effective on October 1, 2007; and
WHEREAS, the City is engaged in a street and sidewalk improvement project known as
the Fourth Street West End Village Improvements Project ("Project"), which the City Council
finds has and will continue to adversely impact the ability of persons shopping in this area to
access on -street public parking and the businesses located within the Project boundaries, due to
the removal of available on -street parking, and the delaying of traffic flow through the Project
area, for the duration of the Project; and
WHEREAS, the City Council finds that the forbearance on the collection of 50% of the
approved on -street metered parking rates in the Project area will encourage retail activity at and
attract shoppers to the businesses located within the Project boundaries for the duration of the
Proj ect.
NOW THEREFORE, BE IT RESOLVED that the Parking Services Manager is
authorized to forebear in the collection of 50% of the on -street metered parking rates for those
metered parking spaces in the Downtown Parking Zone that are located on Fourth Street within
the Project boundaries extending from D Street to the Miracle Mile, for the period commencing
on October 1, 2007 and ending on September 30, 2009 or the date of recordation of the Notice of
Completion for the Project by the City Engineer, whichever date is sooner.
The foregoing Resolution was duly and regularly introduced and adopted at a regular
meeting of the San Rafael City Council held on the 1st day of October, 2007, by the following
vote to wit:
AYES: Councilmembers: Cohen, Heller, Miller, Phillips and Mayor Boro
