HomeMy WebLinkAboutCC Resolution 11943 (1103 Lincoln Ave. Permit Fees)RESOLUTION NO. 11943 A RESOLUTION OF THE SAN RAFAEL CITY COUNCIL WAIVING PAYMENT OF FEES FOR BUILDING PERMIT B0508-007 FOR 1103 LINCOLN AVENUE IN AMOUNT OF $5,001.70 WHEREAS, on March 18, 2002 the San Rafael City Council adopted Resolution 11025 allowing the waiver of planning and building permit fees for certain qualifying projects, including affordable housing developments; and WHEREAS, on January 30, 2006, Jay Zlotnick, Executive Director of the Buckelew Community Housing Development Organization submitted a request to waive fees associated with an application for building permit for seismic upgrading of the 12 -unit apartment building at 1103 Lincoln Avenue, which houses low-income disabled tenants; and WHEREAS, the requested waiver of fees for Permit B0508-007 totals $5,001.70; NOW, THEREFORE BE IT RESOLVED by the City Council of San Rafael that the payment of building permit application fees for the seismic retrofitting of the structures at 1103 Lincoln Avenue is hereby reduced by $5,001.70, finding that the proposed waiver is consistent with the requirements of Resolution 11025 establishing policies for consideration of fee waivers in that: • The Buckelew Community Housing Development Organization is a non-profit organization providing housing to low-income, disabled residents which is identified as a significantly underserved population in General Plan 2020; and • The 12 -unit apartment complex at 1103 Lincoln Avenue is inhabited entirely by low-income and disabled tenants, and affordability is deed -restricted by the State of California; and • The waiver of $5,001.70 would not have a significant impact on General Fund revenues since building permit revenues exceed revenue estimates contained in the 2005-2007 budget.
