RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
REJECTING ALL BIDS FOR THE 2005-2006 ADA CURB RAMP, PROJECT NO.
15006, AND AUTHORIZING STAFF TO REBID THE PROJECT IN THE FALL
OF 2006
WHEREAS, on the l lch day of July, 2006, pursuant to due and legal notice
published in the manner provided by law, inviting sealed bids for proposals for the work
hereinafter mentioned, as more fully appears from the Affidavit of Publication thereof on
file in the office of the City Clerk of the City of San Rafael, California, the City Clerk of
said City did publicly open, examine, and declare all sealed bids or proposals for doing
the following work in said City, to wit:
"2005-2006 ADA CURB RAMP"
PROJECT NO. 15006
in accordance with the plans and specifications therefore on file in the office of said City
Clerk; and
WHEREAS, the lowest bidder, Ghilotti Bros., Inc. was approximately
$250,000 higher than the Engineer's Estimate; and
WHEREAS, the business climate presently favors the contractor who can
pick and choose which projects to bid on; and
WHEREAS, Staff feels Fall of 2006 will be a more conducive time and
more favorable to securing a lower bid; and
WHEREAS, pursuant to section 6.09 of the bid specifications of the contract
documents which states that the awarding authority has the sole discretion to reject all
bids without any stated reason;

NOW, THEREFORE, IT IS HEREBY ORDERED AND RESOLVED
that all bids received for the 2005-2006 ADA Curb Ramp Project be rejected in
accordance with Section 6.09, Instruction to Bidders of the Contract Documents
and staff be directed to rebid the project in the Fall of 2006.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced and adopted
at a regular meeting of the Council of said City held on the 17`h day of July, 2006,
by the following vote, to wit:
