RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AMENDING MASTER FEE SCHEDULE TO ESTABLISH FEES FOR
PROCESSING RIGHT-OF-WAY AGREEMENTS AND RELATED
ENCROACHMENT PERMITS UNDER SAN RAFAEL MUNICIPAL CODE
CHAPTER 11.06.
WHEREAS, San Rafael Municipal Code Chapter 11.06 establishes regulations for City
Council approval of Right -of -Way Agreements for persons desiring to use the City Right -of -Way
for the purpose of providing a specified service; and
WHEREAS, San Rafael Municipal Code Section 11.06.060 provides that each application
for a Right -of -Way Agreement shall be accompanied by initial application fee in an amount
determined by the City to be necessary to pay all estimated expenses incurred by the City in
connection with the processing of such application and the execution of the Right -of -Way
agreement, and thereafter additional application fees as necessary to cover additional estimated
expenses; and
WHEREAS, San Rafael Municipal Code Section 11.06.07(D) provides that after a Right -
of -Way Agreement is approved, no work shall be performed in the City right-of-way without an
encroachment permit, the processing of which encroachment permit may entail more staff time and
other City expense than can now be recovered by the standard encroachment permit fee in the
Master Fee Schedule;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San
Rafael hereby amends the existing Master Fee Schedule, Resolution No. 11871 , Table 1, for
Engineering Services, to establish the fees for processing Right -of -Way Agreements and related
encroachment permits under San Rafael Municipal Code Chapter 11.06, as set forth in Exhibit "A"
attached hereto and incorporated herein.
I, Jeanne M. Leoncini, Clerk of the City of San Rafael, hereby certify that the foregoing
Resolution was duly and regularly introduced and adopted at a regular meeting of the San Rafael
City Council held on the 17th day of July, 2006, by the following vote to wit:
