RESOLUTION OF THE SAN RAFAEL CITY COUNCIL WAIVING COMPETITIVE
BIDDING AND AWARD PURCHASE OF MARINE ENGINES TO CUMMINS WEST,
INC. FOR A SUM NOT TO EXCEED $71, 679.00.
Whereas, the City of San Rafael has operated the police patrol boat, "Mission
City" continuously since 1985; and
Whereas, the City of San Rafael has been made aware that replacement parts
for the engines currently powering the "Mission City" are no longer manufactured
or available; and
Whereas, the City of San Rafael has researched marine engine manufacturers
for replacement engines meeting the specifications for the "Mission City" and
found only one vendor; and
Whereas, Cummins West, Inc. has engines which meet the specifications
necessary to replace the existing engines; and
Whereas, City of San Rafael Municipal Code Section 2.55.070 D allows the City
Council to waive competitive bidding due to necessary restrictions in
specifications.
NOW, THEREFORE BE IT RESOLVED, that the San Rafael City Council waive
competitive bidding and award purchase of marine engines to Cummins West,
Inc. in a sum not to exceed $71,679.00
I, Jeanne M. Leoncini, Clerk of the City of San Rafael, hereby certify that the
foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the San Rafael City Council held on the 7th day of August, 2006 by
the following vote, to wit:
AYES: COUNCILMEMBERS: Heller, Miller, Phillips and Mayor Boro
NOES: COUNCILMEMBERS: None
ABSENT: COUNCILMEMBERS: Cohen
