A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AUTHORIZING THE ESTABLISHMENT OF A NEW RETIREMENT RATE
PLAN UNDER GOVERNMENT CODE SECTION 31676 FOR EMPLOYEES
CURRENTLY EMPLOYED (OR EMPLOYED ON OR AFTER JANUARY 1, 2007)
IN THE SAN RAFAEL FIREFIGHTERS ASSOCIATION AND IN THE SEIU 949
CHILD CARE UNIT
WHEREAS, the City of San Rafael wishes to establish new retirement rates for Firefighters and
Miscellaneous employees in the San Rafael Firefighters Association and for employees in the
SEIU 949 Child Care Unit; and,
WHEREAS, an actuarial was performed and agreements were reached between the City and the
FireFighters Association and the SEIU 949 Child Care Unit. These agreements include the
implementation of the 3% @ 55 formula for Firefighters and 2.7% @ 55 retirement formula for
Miscellaneous employees in both the Firefighters Association and the SEIU 949 Childcare unit,
effective January 1, 2007; and
WHEREAS, Government Code Section 31676 does provide for the retirement rate plans of 2.7%
@ 55 and 3% @ 55; and
WHEREAS, the City of San Rafael wishes to implement these new rates on January 1, 2007;
NOW, THEREFORE BE IT RESOLVED that Government Code Section 31676 for San Rafael
Fire Fighter Association and SEIU 949 Child Care Unit employees (all current, and those hired on
or after date January 1, 2007) be implemented effective January 1, 2007, pending approval of the
Board of Trustees of the Marin County Employees' Retirement Association.

foregoing Resolution was duly and regularly introduced and adopted at a regular meeting of the
City Council of the City of San Rafael, held on Monday, the twentieth day of November, 2006, by
the following vote, to wit:
AYES: Councilmembers: Cohen, Heller, Miller, Phillips and Mayor Boro
NOES: Councilmembers: None
