RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
REJECTING ALL BIDS FOR THE LIBRARY HVAC AND WINDOW
REPLACEMENT 2006, PROJECT NO. 11066, AND AUTHORIZING STAFF TO
REBID THE PROJECT
WHEREAS, on the 7t" day of November, 2006, pursuant to due and legal notice
published in the manner provided by law, inviting sealed bids for proposals for the work
hereinafter mentioned, as more fully appears from the Affidavit of Publication thereof on
file in the office of the City Clerk of the City of San Rafael, California, the City Clerk of
said City did publicly open, examine, and declare all sealed bids or proposals for doing
the following work in said City, to wit:
"LIBRARY IIVAC AND WINDOW REPLACEMENT 2006"
PROJECT NO. 11066
in accordance with the plans and specifications therefore on file in the office of said City
Clerk; and
W11EREAS, the lowest bidder, R -E Corporation was approximately
$200,000 higher than the Engineer's Estimate; and
WHEREAS, the second lowest bidder, DeCarli/Francois Construction
submitted a formal bid protest for the apparent low bidder, R -E Corporation, for
bid irregularities; and
WHEREAS, the lowest bidder, R -E Corportion submitted a formal bid that
contained several irregularites; and
WHEREAS, the second lowest bidder, DeCarli/Francois Construction also
submitted a bid with an irregularity; and
WHEREAS, pursuant to section 3.01 of the Contract Documents that states that the
awarding authority has the sole discretion to reject all bids without any stated reason;
NOW, THEREFORE, IT IS HEREBY ORDERED AND RESOLVED that all
bids received for the Library HVAC and Window Replacement 2006 will be rejected in
accordance with Section 3.01, General Conditions of the Contract Documents, and that
staff will be directed to rebid the project.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced and adopted
at a regular meeting of the Council of said City held on the 20th day of November,
2006, by the following vote, to wit:
