RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
DELEGATING TO AND AUTHORIZING THE MARIN STREETLIGHT
ACQUISITION JOINT POWERS AUTHORITY
TO ASSUME RESPONSIBILITY FOR AND TO ADMINISTER A
TAXICAB REGULATION PROGRAM
WHEREAS, the Marin Streetlight Acquisition Joint Powers Authority ("MSAJPA") is a joint
powers authority formed under Government Code section 6500 et seq. and the City of San Rafael
("CITY") is a member of MSAJPA; and
WHEREAS, the CITY has attempted for many years to regulate the licensing of vehicles for
hire in CITY pursuant to San Rafael Municipal Code Chapter 10.60; and
WHEREAS, due to current CITY budget restraints, the nature of the taxicab industry and the
geography of Marin County, CITY finds that it would be more cost efficient and regulatory
effective to establish, administer and operate a taxicab regulation program on a county -wide
basis; and
WHEREAS, MSAJPA has the authority and the ability, under Section 1 of the Joint Exercise of
Powers Agreement creating Marin Streetlight Acquisition Joint Powers Authority, upon approval
by a majority of its members, to establish, administer and operate a taxicab regulation program
for its member agencies.
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Rafael
does the following:
1) Finds that all of the facts stated in the above recitals, in the accompanying staff report
and in the staff report attachments, are true and correct.
2) Finds that the public health, safety and welfare would best be served by delegating to
and authorizing the Marin Streetlight Acquisition Joint Powers Authority to establish,
administer and operate a taxicab regulation program as a special project under Section
1 of the Joint Exercise of Powers Agreement creating the Marin Streetlight
Acquisition Joint Powers Authority.
3) Delegates to and authorizes the Marin Streetlight Acquisition Joint Powers Authority
to establish, administer and operate a taxi regulation program throughout the County
of Marin, including within the City of San Rafael.

resolution was duly and regularly introduced and adopted at a regular meeting of the San Rafael
City Council held on the 18th day of January, 2005 by the following vote, to wit:
