RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
REJECTING ALL BIDS FOR THE TRAFFIC SIGNAL INSTALLATIONS 2005 AT
NOVA ALBION WAY/ARIAS STREET, NOVA ALBION WAY/ LAS GALLINAS AVE,
LOS RANCHITOS RD/NORTHGATE DR., AND LINCOLN AVE./LINDEN LANE, AND
REBID THE PROJECT
WHEREAS, on the 21St day of June, 2005, pursuant to due and legal notice
published in the manner provided by law, inviting sealed bids or proposals for the work
hereinafter mentioned, as more fully appears from the Affidavit of Publication thereof on
file in the office of the City Clerk of the City of San Rafael, California, the City Clerk of
said City did publicly open, examine, and declare all sealed bids or proposals for doing the
following work in said City, to wit:
"TRAFFIC SIGNAL INSTALLATIONS 2005 AT NOVA ALBION WAY/ARIAS
STREET, NOVA ALBION WAY/ LAS GALLINAS AVE, LOS RANCHITOS
RD./NORTHGATE DR., AND LINCOLN AVE/LINDEN LANE"
PROJECT NO. 11011
in accordance with the plans and specifications therefore on file in the office of said City
Clerk; and
WHEREAS, the low bid was non-responsive in that it failed to provide a
required schedule of values and the second low bid was more than $74,000.00 above the
low bid; and
WHEREAS, the specifications as written may have caused some confusion
among the bidders and;

WHEREAS, the bid amount of the second lowest bidder, Republic
Electric, was $74,055 higher than the lowest bidder; and
WHEREAS, pursuant to section 6.09 of the bid specifications, San Rafael
Municipal Code section 11.50. 100 and section 20166 of the California Public Contracts
Code, the awarding authority has the sole discretion to reject all bids without any stated
reason;
NOW, THEREFORE, IT IS HEREBY ORDERED AND RESOLVED
that all bids received for the Traffic Signals Installations 2005 be rejected in accordance
with Section 6.09, Instruction to Bidders of the Contract Documents; and
BE IT FURTHER RESOLVED that the Director of Public Works is
hereby authorized to rebid this project forthwith; and
BE IT FURTHER RESOLVED that the Director of Public Works is
hereby authorized to take any and all such actions and make changes as may be necessary
to accomplish the purpose of this resolution.
I, JEANNE M. LEONCINI, Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced and adopted at a
regular meeting of the Council of said City on Tuesday, the 5th day of July, 2005 by the
following vote, to wit:
