RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
REJECTING ALL BIDS FOR THE SLURRY SEAL 2004/2005, PROJECT NO.
11054, AND AUTHORIZING STAFF TO REBID THE PROJECT
WHEREAS, on the 91h day of August, 2005, pursuant to due and legal notice
published in the manner provided by law, inviting sealed bids for proposals for the work
hereinafter mentioned, as more fully appears from the Affidavit of Publication thereof on
file in the office of the City Clerk of the City of San Rafael, California, the City Clerk of
said City did publicly open, examine, and declare all sealed bids or proposals for doing
the following work in said City, to wit:
"SLURRY SEAL 2004/2005"
PROJECT NO. 11054
in accordance with the plans and specifications therefore on file in the office of said City
Clerk; and
WHEREAS, the lowest bidder, California Pavement Maintenance Co. Inc.,
was non-responsive in that it failed to sign the Project Bid Proposal and;
WHEREAS, the bid amount of the second lowest bidder, Valley Slurry Seal
Co., was approximately $20,000 higher than the lowest bidder; and
WHEREAS, staff will be revising a portion of the specification requirements
for Thermoplastic Striping to reduce the project cost and;
WHEREAS, pursuant to section 6.09 of the bid specifications of the contract
documents which states that the awarding authority has the sole discretion to reject all
bids without any stated reason;

NOW, THEREFORE, IT IS HEREBY ORDERED AND RESOLVED
that all bids received for the Slurry Seal 2004/2005 be rejected in accordance with
Section 6.09, Instruction to Bidders of the Contract Documents and staff be
directed to rebid the project.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby
certify that the foregoing resolution was duly and regularly introduced and adopted
at a regular meeting of the Council of said City held on the 15`" day of August,
2005, by the following vote, to wit:
AYES: COUNCIL MEMBERS: Cohen, Heller, Miller, Phillips & Mayor Boro
NOES: COUNCIL MEMBERS: None
