HomeMy WebLinkAboutCC Resolution 11862 (Curator Services at Falkirk)RESOLUTION NO. 11862 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE CITY MANAGER TO ENTER INTO AN AGREEMENT FOR PROFESSIONAL SERVICES BETWEEN THE CITY OF SAN RAFAEL AND BETH GOLDBERG FOR CURATOR SERVICES AT FALKIRK CULTURAL CENTER. (Term shall be from December 5, 2005 to June 30, 2006) WHEREAS, the City requires professional services to assist in the development and production of community art education programs and exhibits at the Falkirk Cultural Center; and WHEREAS, Beth Goldberg has the ability to provide such professional services; and WHEREAS, the Marin Community Foundation has provided $50,000 in funding to support these services through July 2006, NOW THEREFORE THE CITY COUNCIL OF THE CITY OF SAN RAFAEL HEREBY RESOLVES AS FOLLOWS: To authorize the City Manager on behalf of the City of San Rafael, to enter into an Agreement for Professional Services Between the City of San Rafael and Beth Goldberg for Curator Services at Falkirk Cultural Center, a copy of which is hereby attached and by this reference made a part hereof. LEONCINI, City Clerk AGREEMENT FOR PROFESSIONAL SERVICES BETWEEN THE CITY OF SAN RAFAEL AND BETH GOLDBERG FOR CURATOR SERVICES AT FALKIRK CULTURAL CENTER This agreement is made and entered into as of this 5th day of December 2005, by and between the City of San Rafael, hereinafter referred to as "City" and Beth Goldberg, hereinafter referred to as "Curator." Section 1. The City hereby contracts with Beth Goldberg as the Exhibition Curator of Falkirk Cultural Center to provide services enumerated in Exhibit "A", per copy attached. The term of this agreement shall be from December 5, 2005 to June 30, 2006 at which time it may be renewed. Section 2. The Curator will report to and receive direction from the Cultural Affairs Supervisor in performance of duties enumerated in Exhibit "A". Section 3. Curator's employment is subject to availability of funding for this position. The source of funding for this position is as follows: twenty-five hours a week, dependent upon grant funds available from the Marin Community Foundation account 276-66-55022. Section 4. The Curator will normally work four days per week (25 hours / week) subject to the restrictions of paragraph 3 of this agreement, and according to a schedule approved by the Cultural Affairs Supervisor. Changes in this 25 -hour -per -week schedule are subject to approval by the Cultural Affairs Supervisor. Section 5. In consideration of the Curator performing the services enumerated in Exhibit "A", she shall be compensated at a rate of $25.00 per hour for hours worked through June 30, 2006. Any overtime in excess of 25 hours per week is compensated at a rate of $25.00 The Director of Community Services must approve, in advance, hours over the authorized 25 per week. Section 6. The Curator will earn retirement benefits paid via PARS (Public Agency Retirement System). Each pay period, 3.75% of the salary will be deducted from the salary and deposited in the Curator's PARS account. Each pay period, the employer will also contribute the equivalent of 3.75% of the Curator's salary into the same PARS account. The Curator will receive the account balance upon termination of employment, retirement, death or permanent and total disability. Section 7. The Curator shall be entitled to health and life benefits at the rate of .67% FTE in addition to those which may be allowed her by the worker's compensation laws of the State of California. The Curator shall earn sick leave at the rate of 5 hours per month (.67% FTE of one (1) work day) commencing with the date of this contract. Sick leave with pay shall be granted for personal illness or illness within the immediate family (spouse and children in the household), or for medical appointments that cannot be scheduled during non -working hours. Vacation benefits shall accrue at 4.19 hours per month (prorated at .67% FTE of 6.25 per month). The Curator may observe the eleven paid holidays allowed by the City of San Rafael. Section 8. The Curator shall be paid twice each month on the business days falling nearest the 15th and the final day of the month. Section 9. Curator and City agree to submit any claims arising under this agreement to binding arbitration pursuant to the current provisions of the California Code of Civil Procedure and any successor statutes. Section 10. Either party may terminate this agreement at any time upon thirty, (30) days written notice to all parties to this agreement. City Manager Date Beth Goldberg Date ATTEST: City Clerk Date Community Services Director Date City Attorney Date Personnel Officer Date 2 EXHIBIT "A" Under administrative direction of the Cultural Affairs Supervisor, the Exhibition Curator develops and implements the exhibits and programs for Falkirk Cultural Center. Curator's duties include, but are not limited to the following: 1. Develop and follow programming schedules for all visual and educational arts programs. Develop and implement a pilot program to expand current Learning to Look schedule. 2. Implement and administer cultural programs under the direction of the Cultural Affairs Supervisor. 3. Supervise volunteers and part-time staff assigned to programs or special projects. Produce reports, records, fund raising materials, correspondence, and press releases. Establish and maintain effective working relations with schools, the press, other City departments, and community organizations to promote community awareness of the arts particularly as it relates to the Falkirk Cultural Center. Assist the Cultural Affairs Supervisor in a broad range of tasks including: budget management, volunteer management, fund raising, public relations, facility maintenance, private rentals and staffing facility.
