LIN INTERNATIONAL/CCS (FORMERLY KNOWN AS CCS ENGINEERING AND PLANNING) RE. SAN RAFAEL GENERAL PLAN 2020 (P00-07) (COMMENCING ON AUGUST 18, 2003 AND ENDING ON JUNE 30, 2004, IN AN AMOUNT NOT TO EXCEED $15,624) WHEREAS, On August 18, 2003, the City of San Rafael (CITY) entered into an Agreement with CCS Engineering and Planning, now know as T.Y. Lin International/CCS (CONTRACTOR) for the provision of planning consulting services in connection with environmental review pertaining to circulation for the San Rafael General Plan 2020 Environmental Impact Report; and, WHEREAS, said Agreement provided for planning services in an amount not to exceed $13,640; and, WHEREAS, due to additional requirements for background and analysis, the CITY has determined that CONTRACTOR'S services need to be extended, and the contract increased a comensurate amount, and the CITY and CONTRACTOR now desire to amend the term of the Agreement; and, WHEREAS, the CONTRACTOR has the expertise and experience to perform the required professional services and is willing and able to continue to provide said services. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of San Rafael that it hereby approves and authorizes the City Manager to sign the Professional Services Agreement amendment with T.Y. Lin International/CCS, a California corporation, for consulting services in connection with the San Rafael General Plan 2020 Environmental Impact Report for an additional amount of $1,984, the total contract expenditure not to exceed $15,624. LIN INTERNATIONAL/CCS (FORMERLY KNOWN AS CCS ENGINEERING AND PLANNING) FOR PROFESSIONAL SERVICES This Amendment to Agreement is made and entered into this 20th day of January 2004 by and between the CITY OF SAN RAFAEL (hereinafter "CITY'), and T.Y. Lin International/CCS, a California corporation (hereinafter "CONTRACTOR"). RECITALS WHEREAS, on August 18, 2003, the City of San Rafael (CITY) entered into an Agreement with CCS Engineering and Planning, now know as T.Y. AGREEMENT NOW, THEREFORE, the parties hereby agree as follows: 1. Paragraph 4 of the Agreement is amended to read as follows: "For the full performance of the services described herein by CONTRACTOR, CITY shall pay contractor as described in Exhibits "A" in the August 18, 2003 agreement and `B" attached and incorporated herein, in a total amount not to exceed $15,624. Payment will be made monthly upon receipt by PROJECT MANAGER of itemized invoices submitted by CONTRACTOR." 2. All other covenants, terms and conditions of the original Agreement remain in full force and effect for the term of the Amended Agreement. Lin International / CCS, I am pleased to submit this proposal to provide the City of San Rafael with additional transportation analysis services on the City's General Plan Update proj ect. T.Y. Lin.'CCS has been providing the City with transportation analysis services related to preparation of the Transportation and Circulation section of the environmental impact report (EIR) on the City's General Plan Update. On October 15, 2003, T.Y. Lin/CCS submitted an initial draft of the Transportation and Circulation section. On November 24, 2003, T.Y. Lin/CCS submitted a revised version of the section; the revised section responded to comments from City staff on the initial draft. The City has recently received comments on the revised administrative draft EIR, based on a legal review by Remy, Thomas, Moose and Manley, LLP. T.Y. Lin/CCS proposes to respond to the comments from Remy, Thomas, Moose and Manley, and prepare a second revised Transportation and Circulation section. T.Y. Lin/CCS' contract amount for the General Plan Update project is currently $13,640. As you and I have discussed, T.Y. Lin/CCS proposes to respond to the legal review comments for an additional cost of $1,984. This will result in a revised contract amount of $15,624. T.Y.
