A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL CONCURRING ON THE MEMBERSHIP OF
THE NEW MARIN COUNTY TRANSPORTATION
AUTHORITY, DESIGNATING THE AUTHORITY AS THE
CONGESTION MANAGEMENT AGENCY FOR THE
COUNTY OF MARIN, APPROVING THE DISSOLUTION OF
A FORMER TRANSPORTATION AUTHORITY CREATED IN
1988 BY THE MARIN COUNTY BOARD OF SUPERVISORS
AND REPEALING CITY COUNCIL RESOLUTION NO.7706
WHEREAS, upon recommendation of the Marin County Congestion Management Agency
(CMA, herein) and pursuant to section 180050 of the California Public Utilities Code, the Marin
County Board of Supervisors (Board of Supervisors) has created the Marin County Transportation
Authority (Authority), as described below; and,
WHEREAS, the Authority has been established to:
1. To improve, construct, maintain and operate transportation programs and projects set
forth in a Transportation Sales Tax Expenditure Plan to be included in any ordinance
imposing a retail transaction and use tax imposed by the Authority;
2. To submit to the voters ballot measures to authorize the imposition of a percent retail
transactions and use tax, and to authorize issuance of limited tax bonds to finance the
transportation programs and projects set forth in the Transportation Sales Tax
Expenditure Plan; and
3. To prepare, adopt, implement, and administer the Congestion Management Program as
the designated Congestion Management Agency for the County of Marin.
WHEREAS, pursuant to the California Public Utilities Code Section 180051 (a) and subject
to the final concurrence of a majority of the cities representing a majority of the incorporated
population, the Board of Supervisors has determined that the Authority shall be composed of
sixteen (16) members, all of whom shall be elected officials of local government entities within the
County of Marin; and,
WHEREAS, the sixteen (16) members of the Authority, shall consist of -

1. The five members of the Board of Supervisors;
2. One member from each City and Town Council appointed by their respective Councils
(eleven (11) City and Town Council members in total).
WHEREAS, pursuant to California Government Code Section 65089 (a) and subject to the
final concurrence of a majority of the Cities/Towns representing a majority of the incorporated
population, the Board of Supervisors has determined that the Authority shall be designated as the
Congestion Management Agency of the County of Marin; and,
WHEREAS, the creation of a Marin County Transportation Authority and the
implementation of a Transportation Sales Tax Expenditure Plan will benefit the citizens of
Marin County; and,
WHEREAS, in 1988, the Board of Supervisors adopted Resolution 88-86, establishing a
Marin County Transportation Authority pursuant to California Public Utilities Code Sections
18000 et seq. and the City Council of the City of San Rafael endorsed this action on March 21,
1988 in Resolution No. 7706; and,
WHEREAS, the Marin County Transportation Authority created in 1988 was originally
composed of one member of the Board of Supervisors, one member of the Novato City Council,
one member of the San Rafael City Council and four members of the Marin County Council of
Mayors and Council Members (MCCMC), with no City/Town allowed to have more then one
representative; and,
WHEREAS, the Marin County Transportation Authority created in 1988 has been dormant
since the early 1990's; consequently and subject to the final approval the Novato City Council,
the San Rafael City Council, and the Marin County Council of Mayors and Council Members
(MCCMC), the Board of Supervisors has dissolved the Marin County Transportation Authority
created by Resolution 88-86;
NOW, THEREFORE , the City Council of the City of San Rafael resolves as follows:
1. The City Council of the City of San Rafael hereby concurs that the Marin County
Transportation Authority shall be composed of sixteen (16) members, all of whom shall be elected
officials of a local governmental entity within the County of Marin.
2. The sixteen (16) members, as of the creation of the Authority, shall consist of:
A. The Five members of the Board of Supervisors, and
B. One member from each Marin County City and Town appointed by their respective
Councils (eleven (11) City and Town Council Members in total).
3. The San Rafael City Council hereby approves designation of the Authority as the designated
Congestion Management Agency for the County of Marin.
4. The San Rafael City Council hereby dissolves the Marin County Transportation
Authority created in 1988 by the Marin County Board of Supervisors Resolution 88-86 and
repeals City Council Resolution No. 7706.

resolution was duly and regularly introduced and adopted at a regular meeting of the Council of said
City on the 15th day of March, 2004 by the following vote, to wit:
