HomeMy WebLinkAboutCC Resolution 11582 (Public Convenience & Necessity; Abbas Sarang dba IM TAXI)RESOLUTION NO. 11582 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL GRANTING A CERTIFICATE OF PUBLIC CONVENIENCE AND NECESSITY AND LICENSE TO OPERATE TO ABBAS SARANG, dba I.M. TAXI WHEREAS, Abbas Sarang, dba I.M. Taxi ("Applicant" herein), pursuant to San Rafael Municipal Code Section 10.60.050, has submitted an application for a Certificate of Public Convenience and Necessity and license to operate a taxi service within the City of San Rafael; and WHEREAS, City Staff have reviewed all of the documents submitted by the Applicant in connection with this application and have provided them to the City Council for its review; and WHEREAS, on June 21, 2004, the San Rafael City Council conducted a duly - noticed public hearing at which time public testimony was heard regarding said application; and WHEREAS, upon a review of the staff report, additional documents and the testimony produced at the hearing, the San Rafael City Council finds that: 1) the Applicant is financially responsible to conduct a taxi service; 2) the Applicant's taxi service will likely be permanent, responsible and satisfactory; 3) the Applicant's listed equipment will provide acceptable service; 4) the Applicant's business would not have an adverse effect on traffic or parking nor on the taxi service to be provided to the public; WHEREAS, the City Council finds that the demands of public convenience require such additional taxi service as Applicant has requested; NOW THEREFORE, BE IT RESOLVED by the City Council of the City of San Rafael as follows: 1. The facts and findings contained in the above -stated recitals are true and correct. 2. Based upon the facts presented in the submitted documents and at the hearing on this matter, a Certificate of Convenience and Necessity and license to operate is hereby granted to Abbas Sarang, dba I.M. Taxi, to provide a taxi service in the City of San Rafael in accordance with the provisions of Chapter 10.60 of the San Rafael Municipal Code and any future amendments thereto. 3. The Administrative Bureau of the Police department is directed to administer and regulate Applicant's operation in accordance with the provisions of Chapter 10.60 of the San Rafael Municipal Code and any future amendments thereto. 4. The grant of Certificate of Public Convenience and Necessity and license for the operation of a taxi service is exempt from review under the California Environmental Quality Act because there is no possibility that the activity in question may have a significant effect on the environment (CEQA Guidelines, section 15061 (b)(3)). 2 I, JEANNE M.
