A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN
RAFAEL WAIVING BIDDING REQUIREMENTS AND
AUTHORIZING THE DIRECTOR OF PUBLIC WORKS TO
PURCHASE 48" DIAMETER PVC STORM DRAIN PIPE FOR THE
SUN VALLEY SCHOOL DRAINAGE IMPROVEMENT PROJECT
IN AN AMOUNT NOT TO EXCEED $80,000.
BE IT RESOLVED by the Council of the City of San Rafael as follows:
WHEREAS, the City of San Rafael and the San Rafael School District are
jointly participating in a project to install a new storm drain pipeline at Sun Valley School;
and
WHEREAS, the new storm drain will be 48" diameter PVC pipe and said
pipe needs to be obtained promptly so as to make sure that the project is timely completed
before the beginning of the school year; and
WHEREAS, to ensure that the pipe is available for the project, staff
recommends that the City Council waive the City's bidding requirements and purchase the
pipe for the project beforehand; and
WHEREAS, under Section 2.55.090 of the Municipal Code, purchases and
contracts for supplies, materials, equipment and services may be made free of the bidding
requirements when those requirements are waived by the City Council in circumstances
where there is a sole source or where "other valid considerations" exist justifying the
waiver;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
San Rafael that the purchase of the 48" PVC pipe may be made free of the bidding
requirements because other valid considerations exist justifying the waiver, namely, that
the project can only be completed prior to the beginning of the school year if the bidding
requirements are waived for this purchase;
RESOLVED FURTHER, that the Director of Public Works is authorized
to purchase the 48" PVC pipe for this project;
RESOLVED, FURTHER, that the Director of Public works is hereby
authorized to take any and all such actions and make changes as may be necessary to
accomplish the purpose of this Resolution.

resolution was duly and regularly introduced and adopted at a regular meeting of the Council of
said City on the 6th day of July, 2004, by the following vote, to wit:
