A RESOLUTION AMENDING A PROFESSIONAL SERVICES
AGREEMENT WITH DES ARCHITECTS/ENGINEERS TO
PREPARE A BOUNDARY SURVEY AND LEGAL DESCRIPTION
FOR A STORM DRAINAGE EASEMENT ACROSS SUN VALLEY
SCHOOL PROPERTY IN AN AMOUNT NOT TO EXCEED
$8,500.00
BE IT RESOLVED by the Council of the City of San Rafael as follows:
WHEREAS, the City of San Rafael and the San Rafael School District
have jointly participated in a project to install a new storm drain pipeline at Sun Valley
School; and
WHEREAS, an easement for the new storm drain needs to be obtained
from the School District, and
WHEREAS, a boundary survey and legal description of the school site
need to be recorded before an easement can be granted to the City, and
WHEREAS, staff finds the content and cost of the amended proposal to be
acceptable and within industry standards;
NOW, THEREFORE, BE IT RESOLVED by the Council of the City of
San Rafael that the amended professional services agreement is accepted in an amount not
to exceed $8,500;
BE IT FURTHER RESOLVED that the Council hereby authorize the
City Manager to execute an amendment to Professional Services Agreement with DES
Architects/Engineers; and
BE IT FURTHER RESOLVED that the Director of Public works is
hereby authorized to take any and all such actions and make changes as may be necessary
to accomplish the purpose of this Resolution.

AMENDMENT TO AGREEMENT
FOR PROFESSIONAL SERVICES
TO COVER ADDITIONAL SERVICES FOR
SUN VALLEY SCHOOL DRAINAGE IMPROVEMENTS
This Amendment to the original Agreement is made and entered into this
2nd day of November, 2004, by and between the CITY OF SAN RAFAEL and DES
Architects/Engineers.
This Amendment covers increasing the original contract budget amount of
$19,600 by approximately $8,500 to cover additional services to prepare a boundary
survey and legal description for a storm drainage easement across Sun Valley School
property.
All the additional work will be in accordance with the attached proposal
dated October 5, 2004 and attached herein as "Attachment A".

The Terms and Conditions contained in the Professional Services Agreement, dated, June 18, 2004
apply to this ASA.
If you are in agreement, please sign both originals and return a fully executed original to DES for
our files. The fully executed ASA will serve as our authorization to proceed with the adjusted
services.

SCOPE OF ADJUSTED SERVICES
The services included in this Adjusted Services Agreement (ASA) cover the effort required for the
following:
Prepare a storm drain easement for proposed public storm drains crossing the school
property that were installed this summer per the construction documents prepared by DES
Architects + Engineers for the purpose of City access, repair and maintenance. Service
includes necessary fieldwork, calculations, drawing and legal description. Note: Because the
subject property is described by metes and bounds and has no Record of Survey recorded, a
boundary survey of the school property will be required and need to be r3ecorded in order to
write a description for the storm drain system.
DELIVERABLES
• Storm Drain easement description, calculations, and recording a Record of Survey for the
Sun Valley School site.
SCHEDULE
• Will commence work within one week of receiving authorization to proceed from the City.
Easement description will be available within 3 weeks after we commence work. Record of
survey normally takes about 6 weeks to get recorded.
