A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL ACCEPTING GRANT OF PEDESTRIAN
EASEMENT FROM REDWOOD VILLAGE OWNERS
ASSOCIATION, DATED NOVEMBER 5, 2004.
WHEREAS, public interest, convenience and welfare will be served by the City
accepting the pedestrian easement hereafter described; and
WHEREAS, the City Council finds that the City's acceptance of said easement is
exempt from environmental review, pursuant to Section 15061(b)(3) of the California
Environmental Quality Act (CEQA) Guidelines, since there is no possibility that such action will
have a significant effect on the environment.
NOW THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
San Rafael, California, that the Grant of Easement, executed by the Redwood Village Owners
Association, dated November 5, 2004, be and the same is hereby accepted, and the Clerk of the
City of San Rafael is hereby directed to cause said conveyance to be duly recorded in the office
of the County Recorder of the County of Marin, State of California, forthwith upon adoption of
this resolution.

that the foregoing Resolution was duly and regularly introduced and adopted at a regular meeting
of the City Council held on the 15`h day of November, 2004, by the following vote to wit:

GRANT Or EASEMENT
For valuable consideration, receipt of which is hereby aclaiowledged,
REDWOOD VILLAGE OWNERS ASSOCIATION, a California non-profit mutual -
benefit, corporation("Grantor"), hereby grants to the CITY OF SAN RAY AEL, a
-charter city ("Grantee"):
a pedestrian access -easement for use by the public for purposes of ingress and egress over
and across the real pioperty located in the City of San Rafael, County of Marin, State of
California, more particularly described and depicted on Exhibit A ("eatement area"),
attached hereto and incorporated herein by this reference;
provided that, notwithstanding such grant of easement, Grantor understands and agrees
that the Grantor, and its successors and assigns, shall have the duty to maintain the
-casement area, and the improvements located therein at their sole cost and expense, and
that Grantee shall have no duty whatsoever to maintain such easement area or the
improvements located therein.
