HomeMy WebLinkAboutCC Resolution 11669 (Redwood Village Pedestrian Easements)RESOLUTION NO. 11669 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL, ORDERING VACATION OF PEDESTRIAN EASEMENTS TRAVERSING LOTS 72 AND 73, LOTS 77 AND 78, AND LOTS 78 AND 79, IN THE REDWOOD VILLAGE SUBDIVISION, SAN RAFAEL, CALIFORNIA WHEREAS, the City Clerk, on behalf of the City Council, published and posted a Notice of Public Hearing on Proposed Vacation of Pedestrian Easements in Redwood Village, as required by law, pursuant to Streets and Highways Code Sections 8320, 8322, and 8323; and WHEREAS, a public hearing was held this day as required by law, at which hearing the City Council of the City of San Rafael heard evidence offered by all persons interested in the vacation of the pedestrian easements herein ordered; and WHEREAS, it appears from the evidence offered and from all of the evidence submitted, and the City Council finds, that the pedestrian easements described hereafter are unnecessary for present or prospective public pedestrian purposes, and that the vacation of said easements will not be inconsistent with the City's General Plan; and WHEREAS, the City Council finds that the proposed vacation of pedestrian easements is exempt from environmental review, pursuant to Section 15061(b)(3) of the California Environmental Quality Act (CEQA) Guidelines, since there is no possibility that such action will have a significant effect on the environment. NOW THEREFORE, IT IS HEREBY RESOLVED AND ORDERED, pursuant to Streets and Highways Code Section 8324, that the pedestrian easements located in the Redwood Village subdivision, San Rafael, California, hereinafter more particularly described, are unnecessary for present or prospective public purposes and are hereby vacated. The pedestrian easements vacated hereunder are located in the City of San Rafael, State of California, and consist of the three 10 feet wide pedestrian easements traversing Lots 72 and 73, Lots 77 and 78, and Lots 78 and 79 of the Redwood Village Subdivision, as shown on that Map entitled "Map of Redwood Village" filed on September 30, 2003, in Volume 2003 of Maps at page 229, Marin County Records, as more particularly described on Exhibit "A" attached hereto. ll` Lr +ua is . \�`O The foregoing Resolution was duly and regularly introduced and adopted at a regular meeting of the San Rafael City Council held on the 15th day of November, 2004, by the following vote to wit: AYES: Councilmembers: Cohen, Heller, Ni l l er and t9ayor Koro NOES: Councilmembers: None ABSENT: Councilmembers: Phillips JEANE M.
