A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
SAN RAFAEL, ORDERING VACATION OF PEDESTRIAN
EASEMENTS TRAVERSING LOTS 72 AND 73, LOTS 77 AND
78, AND LOTS 78 AND 79, IN THE REDWOOD VILLAGE
SUBDIVISION, SAN RAFAEL, CALIFORNIA
WHEREAS, the City Clerk, on behalf of the City Council, published and posted a
Notice of Public Hearing on Proposed Vacation of Pedestrian Easements in Redwood Village, as
required by law, pursuant to Streets and Highways Code Sections 8320, 8322, and 8323; and
WHEREAS, a public hearing was held this day as required by law, at which hearing the
City Council of the City of San Rafael heard evidence offered by all persons interested in the
vacation of the pedestrian easements herein ordered; and
WHEREAS, it appears from the evidence offered and from all of the evidence
submitted, and the City Council finds, that the pedestrian easements described hereafter are
unnecessary for present or prospective public pedestrian purposes, and that the vacation of said
easements will not be inconsistent with the City's General Plan; and
WHEREAS, the City Council finds that the proposed vacation of pedestrian easements is
exempt from environmental review, pursuant to Section 15061(b)(3) of the California
Environmental Quality Act (CEQA) Guidelines, since there is no possibility that such action will
have a significant effect on the environment.
NOW THEREFORE, IT IS HEREBY RESOLVED AND ORDERED, pursuant to
Streets and Highways Code Section 8324, that the pedestrian easements located in the Redwood
Village subdivision, San Rafael, California, hereinafter more particularly described, are
unnecessary for present or prospective public purposes and are hereby vacated.
The pedestrian easements vacated hereunder are located in the City of San Rafael, State
of California, and consist of the three 10 feet wide pedestrian easements traversing Lots 72 and
73, Lots 77 and 78, and Lots 78 and 79 of the Redwood Village Subdivision, as shown on that
Map entitled "Map of Redwood Village" filed on September 30, 2003, in Volume 2003 of Maps
at page 229, Marin County Records, as more particularly described on Exhibit "A" attached
hereto.

The foregoing Resolution was duly and regularly introduced and adopted at a regular
meeting of the San Rafael City Council held on the 15th day of November, 2004, by the
following vote to wit:
AYES: Councilmembers: Cohen, Heller, Ni l l er and t9ayor Koro

ABSENT: Councilmembers: Phillips

An easement for pedestrian access situate ut the City of San Rafael, County of Marin, State of California,
being a strip of land 10 feet in width across a portion of Tots 72 and 73 of the Redwood Village
Subdivision as recorded on that Map entitled "Map of Redwood Village" filed the 30th day of September,
2003 in Volume 2003• of Maps at Pago 229, Marin County Records, the centerline of which is more
particalarly described as follows:
BEGINNING at a point on the southeasterly right-of-way line of Boxwood Drive, as shown on said Map,
said point being the northwesterly intcrscction of the line common to Lots 72 and 73 with said Boxwood
right-of-way; Thence, leaving said right -of --way, South 34°36'39" East, 60.00 feet to a point on the
northwesterly right-of-way line of Almond Court, as said Court is shown on said Map, and the end of this
description.
