HomeMy WebLinkAboutCC Resolution 11681 (Marin Academy Library/Classroom)RESOLUTION NO. 11681 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL ADOPTING A NEGATIVE DECLARATION FOR A GENERAL PLAN 2000 AMENDMENT, ZONE CHANGE, LOT MERGER, ENVIRONMENTAL AND DESIGN REVIEW PERMIT, AND USE PERMIT AMENDMENT IN ORDER TO AMEND THE GENERAL PLAN 2000 LAND USE AND ZONING DESIGNATION OF 1540 FIFTH AVENUE FROM FIFTH AND MISSION RESIDENTIAL/OFFICE TO PUBLIC/QUASI- PUBLIC; MERGE THE PARCELS LOCATED AT 2 COTTAGE AVENUE AND 1540 FIFTH AVENUE; RENOVATE THE EXISTING SCHOOL ADMINISTRATION BUILDING LOCATED AT 2 COTTAGE AVENUE; AND DEMOLISH THE EXISTING MEDICAL OFFICE BUILDING LOCATED AT 1540 FIFTH AVENUE IN ORDER TO CONSTRUCT A NEW TWO-STORY 16,820 -SQUARE -FOOT LIBRARY/CLASSROOM BUILDING WITH ASSOCIATED PARKING, LIGHTING AND LANDSCAPING FOR MARIN ACADEMY (APNs: 011-161-13, 011-193-04, 011-195-01, and 011-195-03) WHEREAS, on July 9, 2004, a General Plan 2000 Amendment, Rezoning, Lot Merger, Environmental and Design Review Permit and Use Permit Amendment applications were received by the Community Development Department requesting approval of renovations to the administration building located at 2 Cottage Avenue and the construction of a library/classroom building at 1540 Fifth Avenue with associated parking and landscaping improvements, and on September 30, 2004, the applications were deemed complete for processing; and WHEREAS, consistent with the requirements of the California Environmental Quality Act (CEQA), an Initial Study/Negative Declaration was prepared for the proposed project, which found that the project would not result in a significant effect on the environment; and WHEREAS, notices regarding the Negative Declaration prepared for this project were published in a local newspaper of general circulation in the area and mailed to surrounding property owners and occupants within 300 feet, pertinent agencies (including responsible and trustee agencies), organizations and special interest groups pursuant to CEQA Guidelines Section 15072; and WHEREAS, copies of the Negative Declaration were made available for a 20 -day review period by pertinent agencies and interested members of the public, commencing on October 19, 2004; and WHEREAS, on November 9, 2004, the Planning Commission held a duly -noticed public hearing on the proposed project and the Negative Declaration, accepting all oral and written public testimony and the written report of the Department of Community Development, and on a 5-0-2 vote recommended to the City Council adoption of the Negative Declaration; and WHEREAS, on December 6, 2004, the City Council held a duly noticed public hearing on the proposed project and the Negative Declaration, accepting all oral and written public testimony and the written report of the Department of Community Development; and WHEREAS, the custodian of documents which constitute the record of proceedings upon which this decision is based is the Community Development Department. NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby adopt a Negative Declaration for the proposed project based on the findings that: • The City Council exercised its independent judgment in evaluating the Negative Declaration, and the Negative Declaration has been considered in conjunction with comments received during the public review period and at the City Council hearing.
