RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING AN AMENDMENT TO THE
SAN RAFAEL GENERAL PLAN 2000 (GPA 04-001) TO AMEND THE LAND USE MAP OF THE
LAND USE ELEMENT RE -DESIGNATING LAND LOCATED AT 1540 FIFTH AVENUE (MARIN
ACADEMY) FROM FIFTH AND MISSION RESIDENTIAL/OFFICE TO
PUBLIC/QUASI PUBLIC (APN 011-195-03)
WHEREAS, on July 9, 2004, an application was received by the Community
Development Department requesting an amendment to the San Rafael General Plan 2000 Land
Use Map of the Land Use Element re -designating land located at 1540 Fifth Avenue from Fifth
and Mission Residential/Office to Public/Quasi Public, and on September 30, 2004, the
application was deemed complete for processing; and
WHEREAS, upon a review of the subject applications, an Initial Study/Negative
Declaration was prepared consistent with the requirements of the California Environmental
Quality Act; and
WHEREAS, the City Council has adopted a Mitigated Negative Declaration for the project
by adoption of a separate resolution; and
WHEREAS, on November 9, 2004, the Planning Commission held a duly noticed public
hearing on the proposed General Plan 2000 Amendment, accepting all oral and written public
testimony and the written report of the Department of Community Development, and on a 5-0-2
vote recommended to the City Council approval of the General Plan 2000 Amendment; and
WHEREAS, on December 6, 2004, the City Council held a duly -noticed public hearing on
the proposed General Plan 2000 Amendment, accepting all oral and written public testimony and
the written report of the Department of Community Development.
NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby approve the
proposed amendment to the General Plan 2000 land use map of the Land Use Element, as
indicated in the attached Exhibit "A-1" and based on the following finding:
The public interest would be served by the adoption of the proposed amendment to re-
designate land located at 1540 Fifth Avenue from Fifth and Mission Residential/Office to
Public/Quasi-Public given that: 1) the project site is adjacent to Public/Quasi Public land
use designations to the north and west and would be used in conjunction with the existing
Marin Academy School; 2) the proposed library/classroom building associated with
Environmental and Design Review Permit ED04-068 would provide improved facilities for
an existing school; and 3) the General Plan 2020 land use designation for 1540 Fifth
Avenue is Public/Quasi Public, which would be consistent with this proposed General
Plan 2000 Amendment.

resolution was duly and regularly introduced and adopted at a regular meeting of the City Council
held Monday, the 6th of December, 2004, by the following vote, to wit:
