HomeMy WebLinkAboutCC Resolution 11685 (Terminate Fire Protection Services Agr.)RESOLUTION NO. 11685 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE CITY MANAGER TO GIVE NOTICE OF TERMINATION OF THE APRIL 6, 1998 FIRE PROTECTION SERVICES AGREEMENT WITH THE MARINWOOD COMMUNITY SERVICES DISTRICT WHEREAS, the City of San Rafael and the Marinwood Community Services District entered into an Agreement for Fire Protection Services, dated April 6, 1998, which provided for mutual fire protection services; and WHEREAS, the City of San Rafael has attempted to negotiate a reduction of the City's current $390,000 payment per year under the Agreement but has been unsuccessful to date; and WHEREAS, the City Council of the City of San Rafael is currently facing a $2,000,000.00 budgetary shortfall in fiscal year 2005-2006 and a $3,000,000.00 shortfall in fiscal year2006-2007 unless drastic measures are taken to increase revenues and/or decrease expenditures; and WHEREAS, the City Council desires to continue to negotiate earnestly with the Marinwood Community Services District to achieve a new operational and structural agreement that will provide the City with greater financial stability while continuing the two agencies cooperation in the provision of fire protection services; and, WHEREAS, because Section 9 of the foregoing Agreement provides that the Agreement may be terminated by either party 180 days after that party has given written notice to the other party and accordingly, the City must give said notice six months in advance of any effective termination date; and, WHEREAS, in the event that the City and the District staffs can reach tentative agreement on fundamental structural and operational issues for the provision of Fire Protection Services, the City Council directs staff to bring before it the proposed new agreement; NOW THEREFORE, BE IT RESOLVED, that the City Council of the City of San Rafael hereby authorizes the City Manager to give the Marinwood Community Services District the 180 days written notice of termination required under Section 9 of said Agreement. The foregoing Resolution was duly and regularly introduced and adopted at a regular meeting of the San Rafael City Council held on the 6th day of December, 2004, by the following vote to wit: AYES: Councilmembers: NOES: Councilmembers: ABSENT: Councilmembers: Cohen, Heller, Miller, Phillips and Mayor Boro Qrsm None AANNE M.
