HomeMy WebLinkAboutCC Resolution 11250 (Disadvantaged Business Enterprise Goal)RESOLUTION NO. 11250 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ADOPTING THE DISADVANTAGED BUSINESS ENTERPRISE ANNUAL OVERALL GOAL FOR 2002/2003. WHEREAS, the City actively seeks federal and state funding to supplement its fiscal budget to improve infrastructure and build new facilities to improve quality of life in San Rafael; and WHEREAS, the City received federal fund obligations for the Medway/ Canal Intersection Improvements for the fiscal years 2002/2003 and 2003/2004; and WHEREAS, the U.S. Department of Transportation requires the Disadvantaged Business Enterprise Annual Overall Goal for fiscal year 2002/2003 be adopted by City Council and be incorporated in the federal funded project bidding process; NOW, THEREFORE, BE IT RESOLVED that the City Council hereby adopts the Disadvantaged Business Enterprise Annual Overall Goal for 2002/2003; and BE IT FURTHER RESOLVED that the Public Works Director or Assistant Director is hereby authorized to take any and all such actions and make changes as may be necessary to accomplish the purpose of this resolution. Duffy, Local Assistance Area Engineer The amount of overall goal, methodology, breakout of estimated race -neutral and race - conscious participation, and any DBE program updates are presented herein in accordance with Title 49 of the Code of Federal Regulations Part 26, and as described in the Local Assistance Procedures Manual. The City of San Rafael submits our annual overall goal information (and any needed updates of our DBE program) for your review and comment. We have established an annual overall DBE goal of 15% for the Federal Fiscal Year 2002/2003, beginning on February 3, 2003 and ending on September 30, 2003. Methodoloev The City of San Rafael used the Census Bureau Data and Caltrans DBE Database to derive the base figure of 15% for the relative availability of DBE's in Marin, Sonoma, Solano, Napa, and Yolo Counties. In the past fiscal years 2000/2001 and 2001/2002, the City has met the DBE Goal Attainment of 12%. Therefore, for this fiscal year, City proposes an annual overall goal of 15%. Breakout of Estimated Race -Neutral and Race -Conscious Participation Of the overall annual 15% goal for DBE participation, the City of San Rafael project meeting 2% of the goal utilizing race -neutral methods, including making efforts to assure that bidding and contract requirements facilitate participation by DBE's and other small businesses; unbundling large contracts to make them more accessible to small businesses; encouraging prime contractors to subcontract portions of the work that they might otherwise perform themselves; and providing technical assistance, and other support services to facilitate consideration of DBE's and other small businesses. The remaining 13% of the goal is anticipated to be accomplished through race -conscious measures, which includes establishing contract specific goals on contracts with contracting possibilities, when needed, to meet the City of San Rafael's overall annual DBE goal.
