APPROVAL OF A RESOLUTION AUTHORIZING A PILOT PROGRAM FOR
SIDEWALK ACTIVITIES DOWNTOWN
BE IT RESOLVED by the Council of the City of San Rafael as follows:
WHEREAS Our Vision of Downtown San Rafael describes Downtown as having
a healthy retail sector and busy, active streetscapes and limited business or other activities
on the sidewalk could bolster retail activities and adding visual interest Downtown; and
WHEREAS, the City has little knowledge of what parameters are acceptable and
what issues must be addressed and this information could be gathered through the
operation of a pilot program.
NOW, THEREFORE IT IS HEREBY RESOLVED that a pilot program be
established for six months. The Economic Development Director, the Executive Director
of the BID and two Council Members will monitor the activities. At the end of the 6
months, staff will make a recommendation to Council as to whether such activities are
warranted Downtown and under what circumstances. The parameters of the program are:
1. The Economic Development Director has the authority to select one or more
businesses to participate in the pilot program and only those in the program may
have activities on the sidewalk;
2. Any activity would be associated with the adjacent retail space and not extend in
front of another retail space;
3. The operation of an activity on the sidewalk is limited to the six month duration of
the program and does not confer the right to continue operation beyond that time;
4. Participation in the program does not eliminate the need to secure any other
required permit such as a business license or County Health Department permit.
I, JEANNE M. LEONCINI, City Clerk of the City of San Rafael, hereby certify
that the foregoing resolution was duly and regularly introduced and adopted at a regular
meeting of the Council of said City held on the 16th day of JUNE , 2003, by the
following vote:
AYES: COUNCIL MEMBERS: Heller, Miller, Phillips and Mayor Boro
NOES: COUNCIL MEMBERS: None
ABSENT: COUNCIL MEMBERS: Cohen
