HomeMy WebLinkAboutCC Resolution 11413 (St. Isabella School Carnival)RESOLUTION NO. 11413 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING A PERMIT TO ALLOW ST. ISABELLA SCHOOL TO HOLD A CARNIVAL OCTOBER 10 12, 2003, AT ONE TRINITY WAY (APNs: 175-181-25 AND 27) WHEREAS, on June 30, 2003, the St. Isabella School Parents Club submitted an application for a permit to allow a carnival to be held on the St. Isabella Parish property at One Trinity Way October 10 — 12, 2003; and WHEREAS, consistent with the requirements of Chapter 10.44 of the San Rafael Municipal Code, a $500 deposit has been submitted to ensure that the property where the carnival is held is left in a neat, clean, healthy and sanitary condition; and WHEREAS, a courtesy notice of the City Council meeting was sent to neighboring property owners within 300 feet of the subject property; and WHEREAS, on September 2, 2003, the City Council considered the proposed carnival permit accepting all public comment and the written report of the Department of Community Development. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Rafael does hereby approve a carnival permit for St. Isabella School to allow a carnival to be held from October 10 12, 2003, as described in letters from Monica Ellen Rizzo, dated June 30 and July 15, 2003, attached as Exhibit "A," subject to the following conditions of approval: 1. No carnival games or rides shall be located within 50 feet of the rear yard fences of homes on Las Pavadas Avenue and Arias Street. 2. Prior to the commencement of the carnival, a site plan showing the location of carnival games and rides shall be submitted to the Community Development Department for review and approval. 3. Set up and tear down of the carnival shall not occur past 9:30 p.m. I, JEANNE M. The carnival is held completely on the private property of St. Isabella Parish. The planned hours of operation are Friday Octoberl0 from 3:00pm to 10:00pm, Saturday October 11 from 11:00am to 10:00pm and Sunday October 13 from 10:00am to 6:00pm. I am enclosing the application and the $500 cleaning deposit. Please let me know if there is anything else that you require from me. I will be out of town from July 26`h -August 20th. If you need to hold a hearing on this issue please schedule it around those dates so that I may attend and answer any questions the council may have. The complaint about noise from the neighbors on Las Pavadas probably relates to the machine gun game that Butler brought last year. This game was backed up along their fences and was in fact very annoying. While we cannot request particular games or rides as per our contract with Butler we are going to insist that there be no gun games this year. Frankly, we do not want a gun game anyway because we do not like to promote violent games. The rest of the games and rides are quite. Butler does not amplify music at St. Isabella like they do at the county fair. We are not having any live entertainment or amplified sound at any of the other games or booths. Parking was a complete non -issue last year. We had volunteers work parking detail and our lot was never even full. We should have no problem providing parking on our own property again this year even though Freitas Parkway is now a bike lane. We had excellent security provided by police officers which we will have again this year. There was not a single incident at the carnival last fall.
