HomeMy WebLinkAboutCC Resolution 11459 (Low Income Housing to Buckelew)CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLUTION NO. 11459 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING THE USE OF TWELVE (12) LOW AND MODERATE INCOME HOUSING UNITS BY THE REDEVELOPMENT AGENCY IN CONJUNCTION WITH THE GRANT TO BUCKELEW COMMUNITY DEVELOPMENT ORGANIZATION (1103 Lincoln Avenue) WHEREAS, the City Council (the "City Council") of the City of San Rafael (the "City") has adopted and amended, from time to time, the Redevelopment Plan (the "Redevelopment Plan") for the Central San Rafael Redevelopment Project Area (the "Project Area"); and WHEREAS, the Redevelopment Agency of the City of San Rafael (the "Agency") is responsible for administering the Redevelopment Plan to cause redevelopment of the Project Area, including the provision of housing available at affordable housing cost to low and moderate income households; and WHEREAS, Buckelew Community Housing Development Organization, Inc. a California nonprofit public benefit corporation (the "Developer") desires to purchase certain real property located outside the Project Area at 1103 Lincoln Avenue (the "Property"). The Property is improved with a fourteen (14) unit residential building which the Developer intends to rehabilitate and rent the twelve (12) of the units at affordable housing cost to very low and low income persons (the "Development"); and WHEREAS, the Agency, by Resolution # 2003-22, approved a grant to the Developer (the "Agency Grant") to finance acquisition of the Property by the Developer; and WHEREAS, the State of California Multi -Family Housing Bonds is one of the sources of financing for the project; and WHEREAS, the State of California has determined it is necessary for the Development to utilize the authorization granted by the electors of the City of San Rafael at the general election of March 8, 1977 to construct or acquire low and moderate income rental units; and WHEREAS, the March 8, 1977 election authorized the construction or acquisition of not more than 120 units of rental housing in downtown San Rafael; and WHEREAS, on September 17, 1979, by Resolution 5767, the City Council of San Rafael authorized the utilization of 83 of the 120 units to be utilized by San Rafael Commons; and WHEREAS, there are 37 units remaining under the authorization from the election on March 8, 1977; NOW, THEREFORE, BE IT RESOLVED that the City Council hereby authorize the San Rafael Redevelopment Agency to utilize up to twelve (12) of the units authorized by the electors of the City of San Rafael at the general election of March 8, 1977 for the Development. BE IT FURTHER RESOLVED that this Resolution shall take immediate effect upon adoption. I, JEANNE M.
