HomeMy WebLinkAboutCC Resolution 11469 (Residental/Office 1800 Fifth Ave)RESOLUTION NO. 11469 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING AN AMENDMENT TO THE SAN RAFAEL GENERAL PLAN 2000 (GPA 03-001) TO AMEND THE LAND USE MAP OF THE LAND USE ELEMENT RE -DESIGNATING .56 ACRES OF LAND LOCATED AT 1800 FIFTH AVENUE FROM HIGH DENSITY RESIDENTIAL TO RESIDENTIAL/OFFICE (APN 010-291-16) (FORMER SAN RAFAEL IMPROVEMENT CLUB PROPERTY) WHEREAS, on April 7, 2003, an application was received by the Community Development Department requesting an amendment to the San Rafael General Plan 2000 Land Use Map of the Land Use Element re -designating .56 acres of land located at 1800 Fifth Avenue from High Density Residential to Residential/Office, and on July 23, 2003, the application was deemed complete for processing; and WHEREAS, the General Plan Amendment was filed concurrently with applications for a Rezoning (ZC03-002) and Environmental and Design Review Permit (ED03-039), which were processed concurrently with the General Plan Amendment application; and WHEREAS, upon review of the subject applications, an Initial Study/Mitigated Negative Declaration was prepared consistent with the requirements of the California Environmental Quality Act; and WHEREAS, the City Council has adopted a Mitigated Negative Declaration for the project by adoption of a separate resolution; and WHEREAS, on November 12, 2003, the Planning Commission held a duly noticed public hearing on the proposed General Plan Amendment, accepting all oral and written public testimony and the written report of the Department of Community Development, and on a 6-0-0-1 vote recommended to the City Council approval of the General Plan Amendment; and WHEREAS, on December 15, 2003, the City Council held a duly -noticed public hearing on the proposed General Plan Amendment, accepting all oral and written public testimony and the written report of the Department of Community Development. NOW, THEREFORE, BE IT RESOLVED, that the City Council does hereby approve the proposed amendment to the General Plan land use map of the Land Use Element, as indicated in Exhibit "A" (attached) and based on the following finding: The public interest would be served by the adoption of the proposed amendment to re- designate the .56 acres of land located at 1800 Fifth Avenue from High Density Residential to Residential/Office in that: a) the project site, while currently designated for residential development has historically (for 80+ years) been used as a gathering hall with legal non- conforming parking and landscaping, and future office use of the property would be required to meet current parking and landscaping requirements; b) the recent seismic retrofitting and near-complete restoration of the exterior of the building to its original 1915 condition, would not be conducive to high density residential development; c) as a transitional area between the downtown commercial and mixed-use designations and the nearby residential designations, the Residential/Office designation would be more compatible with the pattern of existing and future uses in adjacent areas; and d) the proposed project would increase local AL ��o economic activity which provide local opportunities for employment by providing additional office uses near the downtown, while preventing nuisance impacts by including landscape buffers and sound -attenuating construction to avoid aesthetic and noise impacts to adjacent residential uses.
