RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
AUTHORIZING MEMORANDUM OF UNDERSTANDING BETWEEN
THE COUNTY OF MARIN, AND THE CITY OF SAN RAFAEL
AGREEING TO USE, MAINTENANCE, AND LAND TENURE FOR A
SKATEPARK AT MCINNIS PARK
THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows:
WHEREAS the City and County of Marin have agreed to plan, promote and identify funding for
McInnis Park Skatepark, and
WHEREAS the City is eligible for State Park Bond Act Funds to contribute to the construction
costs of McInnis Skatepark, and
WHEREAS to qualify for State park bond Act Funds the City must show proof of a formal
agreement with the County for land tenure, use and maintenance of McInnis Skatepark;
NOW, THEREFORE BE IT RESOLVED THAT THE CITY COUNCIL approves the
Memorandum of Understanding between the County of Marin, and the City of San Rafael agreeing to
use, maintenance, and land tenure for a skatepark at McInnis Park.
The VICE MAYOR and CITY CLERK are authorized to execute, on behalf of the City of San
Rafael, a Memorandum of understanding a copy of which is hereby attached and by this
reference made a part hereof.

foregoing Resolution was duly and regularly introduced and adopted at a regular meeting of the
City Council of said City held on Tuesday, the 22nd day of January, 2002, by the following vote,

MEMORANDUM OF UNDERSTANDING BETWEEN THE COUNTY OF MARIN AND
THE CITY OF SAN RAFAEL REGARDING THE USE, MAINTENANCE, AND LAND
TENURE FOR A SKATEPARK AT MCE"4MS PARK
THIS MEMORANDUM OF UNDERSTANDING, dated January 29, 2002, is by and between
the County of Marin, a political subdivision of the State of California,
(hereafter "COUNTY") and the City of San Rafael, a chartered municipal corporation (hereafter
"CITY").
Article I. Background and Objectives
This Memorandum of Understanding outlines the responsibilities of COUNTY and CITY
relating to the grant proceeds which may be received by CITY to partially fund the construction
of a skatepark complex at the COUNTY'S McInnis Park in San Rafael.
The CITY may receive grant funds from the State of California to be solely utilized for
construction of a skatepark at McInnis Park, owned by COUNTY. As consideration, the State
requests that COUNTY and CITY enter into an agreement to ensure both the tenure of the
skatepark and the ongoing operations and maintenance of the skatepark.
Article II. Statement of Understandings
1. COUNTY agrees to provide land at McInnis Park as the site for construction of a skatepark.
2. COUNTY agrees that the skatepark shall remain in use as such for a minimum period of
twenty (20) years from the date of completion.
3. The COUNTY agrees to operate and maintain the skatepark for a minimum of twenty (20)
years from the date of completion.
Article III. Amendment
This Memorandum of Understanding may be amended or modified only by written agreement of
all parties.
