HomeMy WebLinkAboutCC Resolution 10999 (City Hall at the Mall)RESOLUTION NO. 10999 RESOLUTION AUTHORIZING AN AMENDMENT TO THE SPECIALTY LEASE AGREEMENT BETWEEN MACERICH COMPANY AND CITY OF SAN RAFAEL FOR CITY HALL AT THE MALL (February 1, 2002 - January 31, 2003) Whereas, The City of San Rafael and Macerich Company entered an Agreement dated January 24, 2000, and Whereas, said Agreement was amended by both parties on January 16, 2001 extending the lease through January 31, 2002, and Whereas, said Agreement expires on January 31, 2002 and both parties desire to amend the Agreement extending the term to January 31, 2003, NOW THEREFOR, THE CITY COUNCIL OF THE CITY OF SAN RAFAEL RESOLVES as follows: The CITY MANAGER is authorized to execute, on behalf of the City of San Rafael, an amendment to the Specialty Lease Agreement with Macerich Company, a copy of which is hereby attached and by this reference made a part hereof. L EONCNI, City Clerk boa Macerich Company Ahk "W c DI u k e Goo d Th in g s FI n p p c n" January 11, 2002 Rod Gould, City Manager City of San Rafael Attn: Cory Bytof, Manager City Hall at The Mall 3330 Northgate Mall San Rafael, CA 94903 Re: City Hall at The Mall The Mall at Northgate Dear Rod: This Letter Agreement ("Agreement") has been prepared based upon the following facts: 1) Northgate Mall Associates ("Landlord") and the City of San Rafael (aka City Hall at The Mall) ("Tenant") have entered into a Specialty Lease Agreement dated November 2, 1999 ("Lease"), which is scheduled to terminate on January 31, 2002 and 2) Landlord and Tenant desire by this Agreement to amend the Lease as hereinafter provided. Section 2, Term: The term of this Agreement shall expire January 31, 2003. Section 19 Hours of Operation (Attachment): Total supplement shall be $10,000 for the year or $833.33 per month for the lease year 2002. All other conditions of the Lease shall remain in full force and effect. This Agreement shall not be binding on the Landlord unless and until it is signed by the Landlord and a fully executed copy is returned to you.
