HomeMy WebLinkAboutCC Resolution 11065 (B Street Parking Garage)RESOLUTION NO. 11065 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL ADOPTING A NEGATIVE DECLARATION AND MITIGATION MONITORING AND REPORTING PROGRAM FOR A NEW 7,750 SQUARE -FOOT MUSEUM AND FOURTEEN -CAR PARKING GARAGE AT 1125 B STREET, APN 011-131-03 (Re: Marin History Museum) WHEREAS, on September 12, 2000, applications for a General Plan Amendment (GPA00-05), and Environmental and Design Review Permit (ED00-116) to allow the construction of a 7,750 -square -foot Museum facility, a 5,000 -square -foot storage area and fourteen -car parking garage were submitted and were deemed complete for processing on October 13, 2000; and WHEREAS, on June 14, 2001, an application for a Zone Change (ZC01-11) from Parks/Open Space (P/OS) to Public/Quasi Public (P/QP) was submitted and deemed complete for processing on July 14, 2001; and WHEREAS, consistent with the requirements of the City of San Rafael Environmental Assessment Procedures and the provisions of the California Environmental Quality Act (CEQA), an Initial Study was prepared finding that the proposed project would not result in significant environmental effects in that mitigation measures would mitigate potential adverse impacts to less -than significant; and WHEREAS, consistent with the provisions of CEQA, a Mitigation Monitoring and Reporting Program has been prepared to implement the project mitigation measures and to accompany the Mitigated Negative Declaration; and WHEREAS, pursuant to California Government Code Section 15105(b) notices regarding the Initial Study and the project applications were: a) published in a local newspaper of general circulation in the area; b) provided to the County Clerk; and c) mailed to surrounding property owners within 300 feet, appropriate agencies, organizations, and special interest groups; and WHEREAS, copies of the Initial Study/ Mitigated Negative Declaration were made available for a 20 -day review period by pertinent agencies and interested members of the public, commencing on February 6, 2002; and WHEREAS, the custodian of documents which constitute the record of proceedings upon which this decision is based is the Community Development Department; and WHEREAS, on February 26, 2002, the Planning Commission held a public hearing on the proposed Initial Study/ Mitigated Negative Declaration, accepting public testimony and the written report of the Community Development Department. On a 7- 0 vote, the Planning Commission recommended to the City Council adoption of the Negative Declaration; and b� WHEREAS, on April 15, 2002, the City Council held a public hearing on the proposed Initial Study/Negative Declaration, accepting public testimony and the written report of the Community Development Department. NOW, THEREFORE, BE IT RESOLVED, that the San Rafael City Council does hereby adopt the Negative Declaration and approves the Mitigation Monitoring and Reporting Program as presented in Exhibit "A" attached to this resolution based on the findings that: 1. The City Council exercised its independent judgement in evaluating the Mitigated Negative Declaration and the Mitigated Negative Declaration has been considered in conjunction with comments received during the public review period and at the Planning Commission hearing and the City Council hearing. Based on this review, the City Council has determined that: 1) there is no substantial evidence that the project will have a significant impact on the environment; and 2) revisions have been made to the project and have been included in the project as mitigation measures which reduce the potential impacts to a less -than -significant level. 2. A Mitigation Monitoring and Reporting Program has been prepared to ensure implementation of and compliance with all measures required to mitigate all impacts to less -than -significant levels.
