HomeMy WebLinkAboutCC Resolution 11107 (Redevelopment Project)RESOLUTION NO.11107 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL AUTHORIZING A SPECIAL JOINT PUBLIC HEARING OF THE CITY COUNCIL AND SAN RAFAEL REDEVELOPMENT AGENCY ON JULY 15, 2002, TO CONSIDER ADOPTION OF THE PROPOSED THIRD AMENDED AND RESTATED REDEVELOPMENT PLAN FOR THE CENTRAL SAN RAFAEL REDEVELOPMENT PROJECT WHEREAS, the City Council of the City of San Rafael (the "City Council") has been informed by the San Rafael Redevelopment Agency (the "Agency") that the Third Amended and Restated Redevelopment Plan for the Central San Rafael Redevelopment Project (the "Amended Plan") and a Report thereon are being prepared; and WI IEREAS, the Agency will submit copies of the Amended Plan and Report to this Council for its review; and WHEREAS, there is a need for a joint public hearing with the Agency to consider the Amended Plan and Report, and to have interested groups and citizens be heard on the Amended Plan and Report. NOW, THEREFORE, BE IT RESOLVED that the City Council hereby approves the convening of a joint public hearing with the Agency on Monday, July 15, 2002, at 7:30 p.m., at the City Council Chambers, 1400 5th Avenue, San Rafael, California for purposes of considering the Amended Plan and Report thereon. BE IT FURTHER RESOLVED AND ORDERED that the City Clerk is hereby directed to publish, in cooperation with the Agency, the "Legal Notice - Joint Public Hearing" which has been prepared by Agency staff, a copy of which is on file with the Agency Secretary and by this reference incorporated herein, not less than once a week for four successive weeks in The Marin Independent Journal, a newspaper of general circulation published in Marin County and circulated in the City of San Rafael. BE IT FURTHER RESOLVED AND ORDERED that the City Council hereby directs the City Clerk to cooperate with the Agency in mailing a copy of the Notice to the last known assessee of each parcel of land in the Project Area designated in the Amended Plan, at the assessee's last known address as shown on the last equalized roll of Marin County. BE IT FURTHER RESOLVED AND ORDERED that the City Council hereby directs the City Clerk to cooperate with the Agency in mailing a copy of the Notice to the occupants of each address in the Project Area. 141\15\158082.1 ON \\N BE IT FURTHER RESOLVED AND ORDERED that the City Council hereby directs the City Clerk to cooperate with the Agency in mailing a copy of the Notice to the governing body of each of the taxing agencies which levies taxes upon any property in the Project Area designated in the Amended Plan. Leoncini, Clerk of the City of San Rafael hereby certify that the foregoing resolution was duly and regularly introduced and adopted at a regular meeting of the Council of said City on Monday, the 3rd day of June, 2002, by the following vote, to wit: AYES: COUNCILMEMBERS: Heller, Miller, Phillips and Vice -Mayor Cohen NOES: COUNCILMEMBERS: None ABSENT: COUNCILMEMBERS: Mayor Boro ABSTAIN: COUNCILMEMBERS: None 4• Jeann�ini, City Clerk 141\15\158082.1 2 LEGAL NOTICE SPECIAL JOINT PUBLIC HEARING NOTICE IS HEREBY GIVEN that the San Rafael City Council (the "City Council") and the San Rafael Redevelopment Agency (the "Agency") will hold a Special joint public hearing on Monday, July 15, 2002 at 7:30 p.m. in the City Council Chambers located at 1400 Fifth Avenue, San Rafael, California. The hearing may be continued from time to time until completed. Any person desiring the opportunity to be heard will be afforded an opportunity to do so. The purpose of the hearing is to consider certain amendments described below to the Redevelopment Plan for the Central San Rafael Redevelopment Project, adopted by City Council Ordinance No. 1079 on November 20, 1972, as amended in 1989, 1994, 1998 and earlier this year (the "Plan"). The currently proposed amendments to the Plan are incorporated in a proposed Third Amended and Restated Central San Rafael Redevelopment Plan (the "Amended Plan"). The purpose of the proposed Amended Plan is to increase the amount of tax increment that the Agency is allocated from the Central San Rafael Redevelopment Project Area and to extend the deadline for commencement of eminent domain proceedings by about one year. The proposed Amended Plan will not change any of the other financial provisions of the Plan (e.g. limits on time to conduct plan activities or to collect tax increment, or limits on the amount of outstanding bonded indebtedness), or the proposed activities of the Agency to promote redevelopment of the Project Area. The Project Area is situated in the County of Marin, State of California, and is more particularly described in Exhibit A to the Ordinance 1079, adopted November 20, 1972, recorded in the Offices of the County Recorder of Marin County on December 14, 1972. The boundaries of the Project Area will not be changed as a result of the Amended Plan. It is the intent of the City and the Agency to adopt a Negative Declaration regarding the environmental impacts of the proposed Amended Plan. A copy of this proposed Negative Declaration is available for review at the San Rafael Redevelopment Agency. Any and all persons having any comments on or objections to the proposed Amended Plan, or the regularity of any prior proceeding, or who wish to speak on any issue raised by the Amended Plan or the environmental documentation as it relates to the Amended Plan may appear at the hearing and show cause why the proposed Amended Plan should not be adopted. In addition at any time not later than the time set forth for the hearing on the Amended Plan, any person may file in writing with the City Clerk of the City of San Rafael a statement of objections to the proposed Amended Plan. In accordance with the California Community Redevelopment Law, the Agency has prepared a Report on the Amended Plan. Furthermore, the Amended Plan, Report on the 141 \15\158095.1 Amended Plan, and the related environmental documentation are available for inspection in the offices of the San Rafael Redevelopment Agency, located at 1313 Fifth Avenue, San Rafael, California. This Notice is published pursuant to the order of the City Council of the City of San Rafael and the San Rafael Redevelopment Agency.
