HomeMy WebLinkAboutCC Resolution 11119 (Redesignating Northgate Dr. to Residential)RESOLUTION NO. 11119 RESOLUTION OF THE SAN RAFAEL CITY COUNCIL APPROVING AN AMENDMENT TO THE SAN RAFAEL GENERAL PLAN 2000 TO AMEND THE LAND USE MAP OF THE LAND USE ELEMENT REDESIGNATING 2.8 ACRES OF LAND LOCATED AT 355 LOS RANCHITOS ROAD AND 515 NORTHGATE DRIVE FROM OFFICE TO HIGH DENSITY RESIDENTIAL FOR THE ENTIRE AREA CONTAINED WITHIN ASSESSOR'S PARCEL NUMBERS 175-060-51,-52,-53, AND 54 (GPA 02-02) WHEREAS, on October 3, 2001, and April 10, 2002, the Elder Care Alliance submitted applications to the City of San Rafael requesting approval of a new 120,141 -square -foot, 137 -unit assisted living facility to be located on the property at 515 Northgate Drive; and WHEREAS, the applications include a request to amend the San Rafael General Plan 2000 land use designation of the subject property from Office to High Density Residential, as well as applications requesting a Rezoning, a Master Use Permit and an Environmental and Design Review Permit; and WHEREAS, upon a review of the subject applications, an Initial Study was prepared consistent with the requirements of the City of San Rafael Environmental Assessment Procedures Manual and the California Environmental Quality Act (CEQA) Guidelines, finding that the proposed project would not result in significant environmental impacts; and WHEREAS, the City Council has approved the Mitigated Negative Declaration for the project by adoption of a separate resolution; and WHEREAS, on May 14, 2002, the Planning Commission held a duly -noticed public hearing on the proposed General Plan Amendment and related project applications including a Rezoning, Master Use Permit and Environmental and Design Review Permit, accepted public testimony and the written report of the Department of Community Development, and adopted Resolution No.02-30 recommending City Council approval of the General Plan Amendment; and WHEREAS, on June 17, 2002, the City Council held a duly -noticed public hearing on the General Plan Amendment, accepting all oral and written public testimony and the written report of the Community Development Department. NOW, THEREFORE, BE IT RESOLVED, that the City Council of the City of San Rafael does hereby approve the proposed amendment to the land use map of the Land Use Element, as indicated in the attached Exhibit "A" and based on the following finding(s): � ANAL `�� 1. The public interest would be served by the approval of the proposed amendment to provide a change of use from Office to High Density Residential and would be consistent with land use designations applied to similar developments throughout the City of San Rafael. 2. The proposed General Plan Land Use Map amendment would be consistent with the development in the area as a variety of uses intersect at the subject location and the immediately adjacent property to the south (Drakes Terrace) is also designated a High Density Residential use. The foregoing Resolution No. 11119 was read and introduced at regular meeting of the City Council on the 17th day of June, 2002, and ordered for a second reading by the following vote, to wit: AYES: Councilmembers: Heller, Miller, & Phillips, Mayor Pro tem NOES: Councilmembers: None ABSENT: Councilmembers: Vice -Mayor Cohen & Mayor Boro And will come up for a second reading and adoption at a regular meeting of the City Council to be held on the 1" day of July, 2002. it.
