HomeMy WebLinkAboutCC Resolution 11127 (Central SR Redevelopment Project)RESOLUTION NO. 11127 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL ELECTING STATUTORY PASS-THROUGH PAYMENTS PURSUANT TO HEALTH AND SAFETY CODE SECTIONS 33607.5 AND 33607.7 IN CONNECTION WITH THE REDEVELOPMENT PLAN FOR THE CENTRAL SAN RAFAEL REDEVELOPMENT PROJECT WHEREAS, by Ordinance No. 1776, adopted on March 4, 2002, the City Council of the City of San Rafael (the "City") has adopted the Debt Incurrence Time Limit Deletion Amendment to Second Amended and Restated Redevelopment Plan for the Central San Rafael Redevelopment Project (the "Amendment"), which (1) provides for tax increment financing pursuant to Health and Safety Code Section 33670 ("Tax Increment"), and (2) deletes the date by which the Agency must incur debt; and WHEREAS, the Redevelopment Agency of the City of San Rafael (the "Agency") is considering the adoption of the Third Amended and Restated Redevelopment Plan (the "Amended Plan") for the Central San Rafael Redevelopment Project (the "Project Area"), which (1) provides for tax increment financing pursuant to Health and Safety Code Section 33670 ("Tax Increment"), and (2) increases the amount of Tax Increment the Agency may collect pursuant to the Amended Plan; and WHEREAS, the City of San Rafael is the community that adopted the Amendment and is the community considering adoption of the Amended Plan and is authorized to make the elections described in Health and Safety Code Section 33607.5. NOW, THEREFORE, BE IT RESOLVED that the City of San Rafael elects to be paid the amounts set forth in Section 33607.7 as a statutory pass-through payment from the Agency for each applicable fiscal year the Agency collects Tax Increment from the Project Area. BE IT FURTHER RESOLVED AND ORDERED that the City Manager is hereby authorized and directed to transmit copies of this Resolution to the Agency and to take all other actions required pursuant to Health and Safety Code Sections 33607.5 and 33607.7 to implement the elections set forth in this Resolution.
