A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF SAN RAFAEL
MAKING FINDINGS AND APPROVALS REQUIRED BY THE CALIFORNIA
ENVIRONMENTAL QUALITY ACT IN CONNECTION WITH THE NEGATIVE
DECLARATION PREPARED FOR THE ADOPTION OF THE THIRD AMENDED
AND RESTATED REDEVELOPMENT PLAN FOR THE CENTRAL SAN RAFAEL
REDEVELOPMENT PROJECT AREA
WHEREAS, the City of San Rafael (the "City"), serving as "lead agency" under the
California Environmental Quality Act and the applicable state and local implementing guidelines
("CEQA"), has prepared a negative declaration (the "Negative Declaration") that has evaluated
the Third Amended and Restated Redevelopment Plan (the "Amended Plan") for the Central San
Rafael Redevelopment Project Area (the "Project Area"); and
WHEREAS, the San Rafael Redevelopment Agency (the "Agency") has served as a
"responsible agency" under CEQA in connection with the processing and consideration of the
Negative Declaration; and
WHEREAS, the Negative Declaration, a copy of which is on file with the City Clerk and
Agency Secretary, has served as the CEQA documentation for consideration and approval of the
Amended Plan, and for the Agency's subsequent actions to implement the Amended Plan; and
WHEREAS, the City Council has reviewed the Negative Declaration and the proposed
Amended Plan; and
WHEREAS, the limited purposes of the Amended Plan are to: (i) increase the allowable
total amount of tax increment that may be allocated to the Agency from the Project Area, and
(ii) extend the Agency's eminent domain authority within the Project Area from 2011 to 2012;
and
WHEREAS, the Amended Plan does not affect the boundaries or change land uses of the
Project Area; and
WHEREAS, by staff report accompanying this Resolution and incorporated into this
Resolution by this reference (the "Staff Report"), the City Council has been provided with
additional information upon which the findings and actions set forth in this Resolution are based.
NOW THEREFORE BE IT RESOLVED that the City Council certifies its review and
consideration of the Negative Declaration, and any public comments received thereon, in
accordance with CEQA.
BE IT FURTHER RESOLVED that the City Council hereby finds and determines that
the Negative Declaration adequately addresses the environmental issues pertaining to the

Amended Plan and concludes that the Amended Plan will not have a significant effect on the
environment.
BE IT FURTHER RESOLVED that the City Council approves and adopts the Negative
Declaration.
BE IT FURTHER RESOLVED AND ORDERED that the City Clerk file a Notice of
Determination in accordance with 14 Cal. Code of Regulations, Section 15075, evidencing the
City Council's use of the Negative Declaration in connection with the Amended Plan.
BE IT FURTHER RESOLVED AND ORDERED that this Resolution shall take
immediate effect upon its adoption.

RECOMMENDATION: Approval of Resolution making the California Environmental Quality
Act ("CEQA") findings for the Amended Plan after holding a Special Joint Public Hearing on the
Third Amended and Restated Central San Rafael Redevelopment Plan with the Redevelopment
Agency Board.
BACKGROUND: The Redevelopment Agency is proposing to amend the Redevelopment Plan
to increase the tax increment limit and to extend eminent domain authority from 2011 to 2012.
An amendment of this type requires the Agency to prepare environmental documentation on the
Plan Amendment. A Negative Declaration was prepared for the required environmental review.
The City Council is the Legislative body that must act on the Redevelopment Plan Amendment
and make the CEQA findings after receiving recommendations from the Agency Board. The
Agency Board made the required CEQA findings by Resolution after the Special Joint Public
Hearing on July 15, 2002.

DISCUSSION: The proposed Negative Declaration was prepared in conformance with the
provisions of the California Environmental Quality Act (CEQA) and was circulated for a 30 day
review, a Notice of availability was also published in the Marin Independent Journal and the
document was distributed to all effected taxing entities, the Citizens Advisory Committee on
Redevelopment (CAC), Planning Commission and all affected environmental agencies.
The Planning Commission met on July 91h and adopted a resolution recommending the City
Council adopt the Negative Declaration for the Amended Redevelopment Plan.
FISCAL IMPACT: None.
ACTION REQUIRED: Adopt the Resolution.
ATTACHMENTS: None. The Negative Declaration for the Third Amended and Restated
Redevelopment Plan and the Planning Commission Resolution were provided to the
Redevelopment Agency Board for their action. Additional copies on file with the City Clerk.

Pui.suant to the State of California Public Resources Code aml the "Guidelines liar
Implementation of the Califbrnia Environmental Quality Act of 1970 as amended to date, this is
to advise you that the San Rafael Redevelopment Agency has prepared an Initial Study on Me
following project:
Project Name: Third Amended and Restated Redevelopment Plan for the Central San Rafael
Redevelopment Project Area
Location: The Central San Rafael Redevelopment Project Area comprises the central area of
the City of San Rafael, consisting of the General Plan designated neighborhoods of Downtown,
a portion of Montecito, East San Rafael and Francisco Boulevard West.
Project Description: The Redevelopment Plan was originally adopted by the City of San
Rafael in 1972, and was amended and restated in 1989 and again in 1994. The Plan describes
a generally formulated program for the redevelopment, rehabilitation and revitalization of the
Project Area, and specifically provides the Agency with powers, duties and obligations to
implement the Plan program. This Plan program does not represent a specific plan or establish
priorities for specific projects for the redevelopment, rehabilitation and revitalization of any
particular area within the Project Area. Instead, this Plan presents a process and a basic
framework within which specific development plans will be presented, priorities for specific
projects will be established and specific solutions will be proposed, and provides tools to the
Agency to fashion, develop and proceed with such specific plans, projects and solutions.
The change proposed in this Third Amendment and Restatement is to increase the allowable
tax increment allocated to the Agency in the Central San Rafael Redevelopment Project Area
from $240 Million to $950 Million. This amount includes the allocation for the low and moderate
income housing fund required by the Community Redevelopment Law and the revenues
allocated to the County of Marin, San Rafael Schools, and the College of Marin.
Environmental Issues: The proposed use would result in no potentially significant impacts.
The Initial Study/ Negative Declaration document has been prepared in consultation with
several local, state and federal responsible and trustee agencies and in accordance with
Section 15063 of the California Environmental Quality Act (CEQA). Furthermore, the Initial

Study/ Negative Declaration will serve as the environmental compliance document required
under CEQA for any subsequent phases of the project and for permits/approvals required by a
responsible agency.
A thirty -day (30 -day) public review period shall commence Mav 22, 2002. Written
comments must be sent to the San Rafael Redevelopment Agency, 1313 Fifth Avenue, San
Rafael CA 94901 June 24. 2002. Public hearings on the Initial Study/ Negative Declaration and
the Third Amended and Restated Redevelopment Plan for the Central San Rafael
Redevelopment Project Area will be held by the following City Commissions:
(1) The Citizen Advisory Committee on Redevelopment will review the Initial Study/
Negative Declaration and the Third Amended and Restated Redevelopment Plan for
the Central San Rafael Redevelopment Project Area on Thursday, June 6 at 7:30 p.m.
in the Public Works Conference Room of City Hall, 1400 Fifth Avenue;
(2) The City of San Rafael Planning Commission will review the Initial Study/ Negative
Declaration and the Third Amended and Restated Redevelopment Plan for the Central
San Rafael Redevelopment Project Area on Tuesday, July 9, 2002 at 7:30 p.m. in the
City Council Chambers of City Hall, 1400 Fifth Avenue;
(3) The San Rafael City Council and the San Rafael Redevelopment Agency will hold a
joint public hearing on the Initial Study/ Negative Declaration and the Third Amended
and Restated Redevelopment Plan for the Central San Rafael Redevelopment Project
Area on Monday, July 15, 2002 at 7:30 p.m. in the City Council Chambers of City Hall,
1400 Fifth Avenue.

Million to $900 Million. This amount includes the allocation for the low and moderate income
housing fund (20%) required by the Community Redevelopment Law and the revenues allocated to
the County of Marin, San Rafael Schools, and the College of Marin.
Under the terms of California Community Redevelopment Law, (Section 3354.5(b)), when an
Agency proposes to increase the tax increment allocation, the remaining blight in the Project Area
must be identified as well as the projects that are required to eliminate it and the relationship
between the projects' costs and the increase in tax increment. These items must be included in a
Report on the Plan, and be reflected in the required Agency Five Year Implementation Plan. The
Report on the Plan contains a conceptual project list that demonstrates the remaining blight and the
projects that could address the blight in relationship to the Plan Goals.
The overall Goals to be addressed through implementation projects and actions are:
I ) Alleviate flooding in the East San Rafael and West Francisco Boulevard Area
2) Address Local Recreation Deficiencies
3) Address Intra -city and Regional Circulation Deficiencies
4) Revitalize Downtown and Central San Rafael
5) Promote Economic Development
G) Provide Low and Moderate Income Housing
All the potential implementation projects and actions to achieve these Goals would be consistent
with the provisions of the San Rafael General Plan and the San Rafael Zoning Ordinance. Many of
the projects are not site specific at this point in time, and none have identified construction activities.
Development of detailed site specific information is not feasible until the exact location, magnitude
and timing of the projects are determined. Until such time as each project proceeds from the
conceptual stage to a schematic proposal with a timeframe and estimated budget, detailed
environmental analysis will not be possible. All projects proposed to achieve the established
Agency Goals would require separate and site specific approval and allocation of funds by the San
Rafael Redevelopment Agency, and therefore environmental review. Review and consideration by
local, county and state agencies could also be required, depending on the basics of each project.
9. SURROUNDING LAND USES & SETTING
The Project Area was historically the governmental, commercial, financial and industrial center of
the City. These uses have remained, but over time, became functionally obsolescent. The Project
Area is surrounded largely by residential uses, as contained in the General plan designated
neighborhoods on the north of County Club, Montecito, Lincoln, Fairhills, and Sun Valley; on the
east by the San Francisco Bay; on the south by the San Quentin ridge and California Park, Bret
I larte, Picnic Valley and Gerstle Park; and on the west by the West End Neighborhood. The project
area is the flatter, lower lying portions of central San Rafael, and is surrounded by hills and ridges.
10. OTHER PUBLIC AGENCIES WHOSE APPROVAL IS REQUIRED

None required for the Third Amended and Restated Plan. Review by other agencies could be
required, depending on the project and will be determined as projects are formulated.
