RESOLUTION OF THE CITY COUNCH, OF THE CITY OF SAN
RAFAEL REJECTING ALL BIDS FOR THE PURCHASE OF
SINGLE SPACE PARKING METER EQUIPMENT, BID NO. 501-029
WAIVING COMPETITIVE BIDDING PURSUANT TO SAN
RAFAEL MUNICIPAL CODE SECTION 2.55.070(D), AND
AUTHORIZING STAFF NEGOTIATIONS TO CONTRACT FOR
THE PURCHASE OF THE EQUIPMENT IN AN AMOUNT NOT TO
EXCEED $300,000.
WHEREAS, on the 11`h day of September, 2002, pursuant to due and legal notice
published in a manner provided by law, inviting sealed bids for the equipment hereinafter
mentioned, the City Clerk of the City of San Rafael did publicly open, examine and declare all
sealed bids or proposals for furnishing the following equipment:
SINGLE SPACE PARKING METER EQUIPMENT - BID NO. 501-02
in accordance with the specifications therefore on file in the office of said City Clerk; and
WHEREAS, the City Council has reserved the right to reject all bids pursuant to Section
2.55.160 of the San Rafael Municipal Code, which reservation of right is referenced in Section
II, item 17 of the Request for Bids; and
WHEREAS, the City Council may approve the waiver of competitive bidding for the
purchase of equipment, and authorize purchases of such equipment by City staff without
recourse to competitive bidding where valid reasons exist to do so, pursuant to San Rafael
Municipal Code Section 2.55.070(D); and
WHEREAS, staff recommends the rejection of all bids for the purchase of the Single
Space Meter Equipment due to ambiguities in the bid specifications, which have raised issues as
to the propriety of any bid award; and

WHEREAS, the City Council finds that valid reasons exist at this time for the waiver of
competitive bidding for purchase of the Single Space Parking Meter Equipment, since such
equipment could not be obtained on a timely basis with a rebid of the purchase, and contracts for
purchase of the equipment must be completed by staff negotiations with one or more vendors on
an expedited basis in order to assure timely delivery of the equipment and avoid significant
financial losses by the City's Parking Services Division;
NOW, THEREFORE, IT IS HEREBY RESOLVED by the City Council of the City of
San Rafael that the Mayor and City Clerk are authorized to reject all bids for the Single Space
Parking Meter Equipment, Bid No. 501-2.
IT IS FURTHER RESOLVED that the City Manager is authorized to negotiate and
execute a contract or contracts, in a form approved by the City Attorney, with one or more
vendors for purchase of single space parking meter mechanisms, meter housings, collection
equipment, and other components for on -street and off-street parking operations in San Rafael,
in a total amount not to exceed $300,000.00.

foregoing Resolution was duly and regularly introduced and adopted at a regular meeting of the
City Council of said City held on Monday, October 7, 2002, by the following vote, to wit:
